EAGLE CITY COUNCIL
Special Meeting Minutes
July 2, 2008
1. CALL TO ORDER: Mayor Bandy calls the meeting to order at 10:00 a.m.
2. ROLL CALL: GUERBER, HUFFAKER, SHOUSHTARIAN, SEMANKO. Shoushtarian is
absent. A quorum is present.
3. EXECUTIVE SESSION:
A. Pending or Threatened Litigation: I.c. S 67-2345 (f)
B. Acquisition of private propeliy. I.C. S 67-2345 (c)
Semanko moves to go into Executive Session for Pending or Threatened Litigation: I.C. ~
67-2345 (f) and Acquisition of Private Property: I.C. ~ 67-2345 (c). Seconded by Huffaker.

CARRIES..............
City Attorney Buxton: Pending Litigation for the Executive Session is for allegations made by
legal council for Eagle Water Company in regards to hooking up to the water tank and in order to
review and resolve this we are looking at acquisition of private property issues with Eagle Water.
Council goes into Executive Session at 10:05 a.m.
Council discusses pending or threatened litigation and acquisition of private propeliy.
Council leaves Executive Session at 12:23 p.m.
Huffaker moves to reauthorize the Mayor to continue negotiations with Eagle Water
Company and that our counsel, Susan Buxton, is to participate in that process and that
they continue to discuss the terms that we discussed in Executive Session with the
understanding of trying to work towards an Intertie Agreement with Eagle Water
Company and that the Mayor and/or Susan attend the PUC meeting to basically update the
PUC on what the status of our negotiations are at this time. Seconded by Semanko.

4. ADJOURNMENT:
Guerber moves to adjourn. Seconded by Semanko. ALL AYES: MOTION CARRIES...
