Special Meeting Minutes
May 27, 2008
1. CALL TO ORDER: Mayor Bandy calls the meeting to order at 1 :00 p.m.
2. ROLL CALL: GUERBER, HUFFAKER, SHOUSHTARIAN, SEMANKO. All present. A quorum is present.
3. EXECUTIVE SESSION:
A. Pending or Threatened Litigation: I.C. S 67-2345 (1)
B. Acquisition of private property. I.C. S 67-2345 (c)
Mayor introduces the issue.
Guerber moves to go into Executive Session under Idaho Code ~ 67-2345 (f) pending or threatened litigation and
Idaho Code ~ 67-2345 (c) acquisition of private property. Seconded by Huffaker. Discussion City Attorney:
pending or threatened litigation is in regards to an e-mail the city attorney received referencing Eagle Water
Company and the acquisition of private property is in regards to Eagle Water Company. Guerber: AYE;
Huffaker: AYE; Shoushtarian: AYE; Semanko: AYE: ALL AYES: MOTION CARRIES..............
Council goes into Executive Session at 1 :05 p.m.
Council discusses pending or threatened litigation and acquisition of private property in regards to Eagle Water
Company.
Council leaves Executive Session at 2:20 p.m.
Guerber moves to approve the claims against the City. Seconded by Huffaker. Guerber: AYE; Huffaker: AYE;
Shoushtarian: AYE; Semanko: AYE: ALL AYES: MOTION CARRIES..............
4. ADJOURNMENT:
Guerber moves to adjourn. Seconded by Huffaker. ALL A YES: MOTION CARRIES......................
Hearing no further business, the Council meeting adjourned at 2:25 p.m.
