Re: Expiration of Building Permit Applications (05-09-093 & 05-09-094) at 3094 S Stonington Ave.
Dear Dale Hessing,
On September 14, 2006 the City of Eagle received your letter requesting an extension of time for the
building permit application for a Residential & Garage Addition located on Lot 4 Block 11 of the Banbury #7
Subdivision. To accommodate your request, your permits were extended to March 6`h, 2007 under Eagle City
Code Section 7-1A-3 & 7-1A-4. This section, as adopted by the Eagle City Council, limits a permit holder and
applicants to only one extension.
The applications are now deemed expired as of April 24, 2008, under the following Building Code:
Eagle City Code Sections 7-1A-3 & 7-1A-4 has amended the 2003 International Building &
International Residential Code Sections R105.3.2 which allowed a 90 day extension, to be increased to a period of
180 Days to grant more flexibility to the building community when unforeseen conditions are presented.
IBC 8 IRC sections 105.3.2 are amended to read as follows:
105.3.2 Expiration Of Plan Review. Applications for which no permit is issued within 180 days following the date
of receipt of application shall expire by limitation, and plans and other data submitted for review may thereafter be
returned to the applicant or destroyed by the building official. The building official may extend the time for action
by the applicant for a period not exceeding 180 calendar days on request by the applicant showing that
circumstances beyond the control of the applicant have prevented action from being taken. No application shall
be extended more than once, nor shall any extension be granted beyond the last day of the current code cycle as
adopted by the city of Eagle. In order to renew action on an application after expiration, the applicant shall
resubmit plans and pay a new plan review fee.
The City of Eagle regrets this project will not move forward. If you have any questions regarding this
action, I can be reached at 489-8760.

On September 6, 2006, the City of Eagle received your letter requesting and extension of
time regarding the issuance of building permits for a kitchen/garage building located on Lot 4
Block 11 of the Banbury #7 Subdivision. Your company was contacted on September 28, 2005,
notifying you that the permit was ready to be issued.
Eagle City Code Section 7-1A-9 has amended the 2003 International Building Code
Section 105.5, which allowed a 90 day extension, to be increased to a period of 180 Days to grant
more flexibility to the build community when unforeseen conditions are presented.
To accommodate your request, the applications for your permits are extended to March 6,
2007 under Eagle City Code Section 7-1A-9. This section, as adopted by the Eagle City Council,
limits a permit holder and applicants to only one extension.
We will be available to review any changes which may develop during this time frame
and are ready to answer any questions regarding this determination.

Dear Mike,
I am writing to request an extension to a building permit granted by your
office. The permit is under the name of Dale Hessing at the address 3094 S
Stonington Ave, Eagle.
The reason for the lengthy time and now a request for an extension is that it
has taken more time than anticipated to line up contractors due to the
building boom in the valley and line up financing. My plan is to start the
project in the spring as early as the weather will allow. I do have bids in and
financing is ready, however I am reluctant to start this late in the year.
Hopefully this will work for you. Let me know if there is something else I need
to do.
