ORDINANCE 600
AN ORDINANCE OF THE CITY OF EAGLE, IDAHO, AMENDING TITLE 5 POLICE
REGULATIONS, ADDING CHAPTER 10 SPEED LIMITS, ESTABLISHING A PENALTY,
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, concern has been expressed by the Eagle Chief of Police and residents of
the City of Eagle that excessive vehicle speed upon streets within the City, and more specifically
neighborhoods, exposes residents and property to unnecessary harm; and
WHEREAS, the City Council (the "Council") of the City of Eagle, recognizing the need
to regulate excessive vehicle speeds to deter the creation of hazardous conditions to residents,
businesses, and visitors, has determined that the establishment of maximum speed limitations are
necessary to protect the health, safety, welfare, and happiness of the citizens of Eagle; and
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF EAGLE, Ada County, Idaho;
Section 1: That Title 5, Chapter 10, of the Eagle City Code is hereby added to read:

5-10-1:
GENERAL SPEED LIMITS: No person, other than authorized emergency
vehicle personnel, shall drive a vehicle at a speed in excess of the following:
1. Twenty-five (25) miles per hour, unless otherwise posted, on any public street
within the corporate city limits.
2. Ten (0) miles per hour on any throughway, or in any parking lot in a public
park.
.1. Ten (0) miles per hour on any public alley.

PENALTY: Any person that violates any provision(s) of this section shall be
deemed guilty of an infraction and subiect to the penalties set forth in Idaho
infraction rule 9(b) (other infractions).

5-10-3:
SCHOOL ZONE AND PENALTY:
A. No person, other than authorized emergency vehicle personnel, shall drive a
vehicle at a speed in excess of twenty (20) miles per hour in a marked school zone
when any of the following exist:
L A school speed limit sign with flashing lights attached and the words "when
flashing" posted and the lights are activated; or
2. A school speed limit sign with "when children are present" included thereon,
and there is a child or children present. "When children are present" shall be
defined to mean whenever one or more children are present and clearly visible
on the roadway, shoulder area, sidewalk, or other area immediately adiacent to
the roadway on which the school zone is located. This definition applies to
children present on the same side of the street as the school building, as well
as across the street from the school building or in any direction within the
marked school zone, and is not restricted to school days or hours; or
.1. A school zone speed limit sign with "7:00 a,m. to 4:30 p,m." included thereon.
B. Any person that violates this subsection shall be guilty of an infraction and
shall be assessed a fixed penalty of one hundred dollars ($100.00) excluding court
costs and fees.
Section 2: If any provision in this Ordinance shall be declared by any court of competent
jurisdiction to be contrary to law, then such provision shall be null and void and shall be deemed
separable from the remaining provisions in this Ordinance and shall in no way affect the validity
of the other provisions of this Ordinance or Eagle City Code.
Section 3: All prior ordinances or parts thereof, to the extent inconsistent herewith, are
hereby repealed and shall, to the extent of such inconsistency, have no further force or effect.
Section 4: This Ordinance, or a summary thereof in compliance with Section 50-90 I A,
Idaho Code, shall be published once in the official newspaper of the City, and shall take effect
immediately upon its passage, approval, and publication.
