The Design Review Board having heard and taken oral and written testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law; STAFF FINDINGS OF FACT: A. PROJECT SUMMARY: Pinewick Investment Company, represented by Jim Rehberg with Idaho Electric Signs, is requesting design review approval of a master sign plan for the King's Shopping Center, including one building wall sign and one monument sign. The 0.33-acre site is located on the north side of West State Street approximately 92 I-feet west of North Eagle Road at 300-344 West State Street. B. LETTERS FROM THE PUBLIC: None received to date STAFF ANALYSIS PROVIDED WITHIN THE STAFF REPORT: A. COMPREHENSIVE PLAN PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: . Protect and enhance the small town character of the City by requiring signage which is creative and distinctive, compatible with its surroundings, and an integral component of the style and character of the building to which it relates. B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: . Eagle City Code Section 8-2A-2(B) The general theme of the Design Review Overlay District is to specifY desirable building and landscape architectural styles and materials to create a sustainable and pleasing environment for residents and visitors alike. The architectural designs, materials, and graphics set forth in this article are complied to create a theme unique to the area called "Eagle Architecture". . Eagle City Code Section 8-2A-6(A)(4) Signage for any project shall provide for business identification and minimize clutter and confusion on and off the site. . Eagle City Code Section 8-2A-6(A)(4)(c) Signs are to provide effective and necessary business identification systems adapted to the building design. . Eagle City Code Section 8-2A-6(A)(4)(e) The size, location, design, color, texture, lighting, landscaping, and hours of operations of all permanent signs and outdoor advertising structures or features to insure that any such proposals do not detract from the function of, or design of, buildings, structures, surrounding properties, neighborhoods, or streets. · Eagle City Code Section 8-2A-8(C)(1) Sign materials and overall appearance shall compliment the building architecture and colors as Page 2 of8 K:\Planning Dept\Eagle Applications\Dr\2007\DR-61-07 King's mstr sign plan drfdoc determined by the Design Review Board. · Eagle City Code Section 8-2A-8(C)(4)(c) The total area of any wall sign attached parallel to, or painted on the face of a building shall not exceed ten percent (10%) of the total area of the building face to which it is attached or painted . Eagle City Code Section 8-2A-8(C)(5)(a) Monument signs located within the TDA shall not exceed six feet (6') in height (including the solid base) measured from the centerline of the adjacent roadway or top of curb, if one exists. . Eagle City Code Section 8-2A-8(C)(5)(e) A "shopping center", as defined in section 8-1-2 of this title shall be allowed one monument sign per street that it abuts, to identifY the shopping center. If the shopping center has a single address, the address shall be located on the monument sign and shall be a size that is readable from the street. The height of any such sign, including the base to which it is attached, shall not exceed fifteen feet (15 '). The surface area of any such sign shall not exceed one hundred (100) square feet per exposed surface, including any reader board sign or surface. . Eagle City Code Section 8-2A-8(K)(1) No signs shall be erected or maintained in any district as established by the Zoning Ordinance except those signs specifically enumerated in this Chapter. The number and area of signs as outlined in this Chapter are intended to be maximum standards which do not necessarily ensure architectural compatibility. Therefore, in addition to the enumerated standards, consideration shall be given to a sign's relationship to the overall appearance of the subject property as well as the surrounding community. Compatible design, simplicity and sign effectiveness are to be used in establishing guidelines for sign approval. C. DISCUSSION: . The applicant is requesting approval of a master sign plan which will bring existing signage into compliance with Eagle City Code. Because King's Shopping Center currently does not have a master sign plan in place existing tenants are operating their businesses without signage or without approved signage. The existing "King's" wall sign is internally illuminated which is not permitted per Eagle City Code. The applicant has offered to remove the internal lighting and instead illuminate the sign with gooseneck lights. The existing monument is also not in compliance with City Code because it has an internally illuminated cabinet design. The applicant has proposed to replace the cabinet portion of the sign with tenant panels and will illuminate the monument sign with external, ground mounted lighting. Staff has met with the applicant and determined that because the design of the existing building is not compliant with Eagle City Code a complete change out of the existing signage is not warranted at this time. Staff therefore recommends that the existing building sign and monument sign for King's should be allowed to be brought into minimal compliance with City Code until such a time that the building is either remodeled or replaced. . Staff recommends the following changes to the applicant's document titled "King's Master Sign Plan", with strike thru text to be deleted and underlined text to be added so as to be in compliance with Eagle City Code. Each tenant or occupant shall be required to submit signage plans to the building's managing entity for written approval. A design review sign application, accompanied by the written approval of the b\:lilding's, managing entity shall be submitted to the City of Eagle for any proposed teRaHt signs for City Staff review and approval. All signs shall be in compliance with the criteria stated herein as well as Eagle City Code. In cases of any conflict between Eagle City Code and the criteria specified herein, the more restrictive shall apply. 2. Flat Wall Signs: a. Building wall signs shall be placed on the parapet walls directly above the tenant main entry doors. b. Tenant signs on the sO\:lth and west elevations shall not exceed fifty (50) sE}l:Iare feet, exeept for the existing King's sign, whieh shall not be enlarged. ten percent (10%) of the total width of the tenant space multiplied by twelve feet illl. c. Letters shall be non-illuminated or halo illuminated. d. Letters shall be flat or matte black or other approved earth-tone colors. No glossy paints, vinyl, or plexi-glass is permitted. e. All letters and logos within the building wall signs shall be constructed of a high-density urethane material, Y2"-thick (minimum). f. All wall mounted signs will be illuminated with fixtures mounted on the building wall above the signs, and shall be located so as to not shine onto any roadway or onto nearby properties. 3. Parallel Wall Signs: a. Tenant signs shall not exceed ten percent (10%) of the total width of the tenant space multiplied by twelve feet (12'). b. Letters shall be externally illuminated. c. Letters shall be flat or matte black or other approved earth-tone colors. No glossy paints, vinyl. or plexi-glass is permitted. d. All letters and logos within the parallel wall signs shall be constructed of a high-density urethane material. Y2"-thick (minimum), or the face of wood signs shall have dimension bv routing or extrusion, with a minimum 1;4" relief. e. A minimum distance of 7' 6" shall be maintained between the bottom of the sign and sidewalk. f. The perpendicular wall sign shall not extend over thirty six inches (36") from the wall of the building or structure. Monument Siens 1. One existing monument sign is provided for use of the tenants in the "King's Building". The King's Building managing entity has final approval of the location of the tenant's identification. All tenant signs shall be placed on a cream colored background. 2. The existing monument sig:n will be redesigned so that the internally illuminated cabinet is replaced with tenant panels. Also. the word "King's" on the cap of the existing monument sign will be replaced with the address letters "300-344". 3. Exterior illumination for the monument sign shall be recessed, and shall be shielded with landscape materials maintaining year-round effective screenffig. One (1) fixture with a 100-watt high pressure sodium light source shall be allowed on the east and west eaeft side side of the monument sign. 4. Letters on the tenant panels provided on the monument sign shall be "bloek" fORt tm6 3 Y2" high. The maximum logo size permitted shall be 6"-high x 8"-wide. :\llletters and logos shall be blaek. 5. Internal illumination is not permitted. Miscellaneous 1. Any signage on doors or windows shall comply with Eagle City Code. 2. Any temporary or grand opening sign shall comply with Eagle City Code. 3. Upon termination of their lease, the tenant or managing entity shall neatly seal all penetrations of the building structure in a water tight condition that matches the texture. color and material used in the construction of the building. . Staff defers comment regarding design and color of all proposed signs to the Design Review Board. STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT: Based upon the information provided to staff to date, staff recommends approval with the site specific conditions of approval and the standard conditions of approval provided within the staff report. PUBLIC MEETING OF THE BOARD: A. A meeting was held on the application before the Design Review Board on January 10, 2008, at which time the Board made their decision. B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one. C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not including the applicant/representative). BOARD DECISION: The Board voted 6 to 0 (Weber absent) to approve DR-61-07 for a design review application for a master sign plan for King's Shopping Center for Pinewick Investment Company, with the following staff recommended site specific conditions of approval and standard conditions of approval. The following document titled "Master Sign Plan Criteria for King's Shopping Center" shall be the master sign plan criteria for the Stanford Multi-tenant Building: Master Sign Plan Criteria for King's Shopping Center Each tenant or occupant shall be required to submit signage plans to the building's managing entity for written approval. A design review sign application, accompanied by the written approval ofthe, managing entity shall be submitted to the City for any proposed signs for City Staff review and approval. All signs shall be in compliance with the criteria stated herein as well as Eagle City Code. Upon termination of their lease, the tenant or managing entity shall neatly seal all penetrations of the building structure in a water tight condition that matches the texture, color and material used in the construction of the building. 2. The developer owner or managing entity shall be notified that within 6 months of the final approval date of this master sign plan that all existing signs shall be brought into compliance with the master sign plan and no sign applications shall be reviewed by staff or the Design Review Board until this condition has been met. 3. A sign permit is required prior to the installation of any signs on this site. 4. The applicant shall provide a landscape plan for the monument sign detailing a landscape design for the base of the sign that is equal to three (3) times the size of the largest exposed surface. The landscape plan will be reviewed and approved by staff and one member of the Design Review Board prior to the issuance of a zoning permit for the monument sign. 5. Provide a revised elevation plans showing a red rectangular design element located beneath the address numbers on the cap of the monument sign. The revised elevation plans shall be reviewed and approved by staff and two members of the Design Review Board prior to the issuance of a sign permit. STANDARD CONDITIONS OF APPROVAL: 1 . A building permit/zoning permit shaD be required prior to construction of any sign which is not attached to a building with an active building permit. 2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review, as stipulated in Eagle City Code (one year from the City Council approval date). 3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with. All design and construction shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the City Council. 4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may elect to take those plans to the Design Review Board and the City Council for review and approval. Any changes to the plans and specifications upon which this approval is based, other than those required by the above conditions, will require submittal of an application for modification and approval of that application prior to commencing any change. 6. Any change by the applicant in the planned use ofthe property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the City of Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 7. Any modification of the approved design review plans must be approved prior to construction/installation of such changes. Failure to do so may result in the requirement to modifY the project to comply with the approved design review and/or result in the inability to issue a certificate of completion for this project. CONCLUSIONS OF LAW: 1. The application for this item was received by the City of Eagle on August 31,2007. 2. The Board reviewed the particular facts and circumstances of this proposed design review application (DR-61-07) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review Overlay District, and based upon the information provided with the conditions required herein, concludes that the proposed design review application is in accordance with the Eagle City Code and the Eagle Comprehensive Plan.
