Dear Sirs:
This application for a building permit covering tenant improvements for Lounge 83, 1065 E
Winding Creek Drive, Suite# 150, was received in our office on June 11, 2007. You were notified by
phone on June 27, 2007 that the permit was ready and could be picked up with the presentation of the
required sewer permit and ACHD documentation.
Eagle City Code Section 7-1A-3 has amended the 2003 International Building Code Section
105.3.2, which allowed a 90 day extension, to be increased to a period of 180 Days to grant more
flexibility to the build community when unforeseen conditions are presented.
This permit has not been picked up; therefore it is deemed expired under the following:
Eagle City Code Section 7-1A-3:IBC BUILDING CODE AMENDMENTS:
_IBC section 105.5 is amended to read as follows:
IBC section 105.3.2 is amended to read as follows
105.3.2 Expiration of Plan Review. Applications for which no permit is issued within 180 days
following the date of receipt of application shall expire by limitation, and plans and other data
submitted for review may thereafter be returned to the applicant or destroyed by the building
official. The building official may extend the time for action by the applicant for a period not
exceeding 180 calendar days on request by the applicant showing that circumstances beyond the
control of the applicant have prevented action from being taken. No application shall be extended
more than once, nor shall any extension be granted beyond the last day of the current code cycle as
adopted by the city of Eagle. In order to renew action on an application after expiration, the
applicant shall resubmit plans and pay a new plan review fee.
