RE: Expiration of Application # 07-03-075
Dear Sirs:
On December 14, 2006 the City of Eagle received your application for a building permit
for the tenant improvements for Citizen Smith Restaurant and Chateau Lounge to be located at
291 E Shore Drive, Suite # 100. We have tried since March 30' 2007 to obtain the mechanical
bids in order to complete the permit calculations, but have not received any communication from
you since June 13, 2007.
As this application was never permitted it is deemed expired under the following:
Eagle City Code Section 7-1A-3: IBC BUILDING CODE AMENDMENTS:
IBC section 105.5 is amended to read as follows:
IBC section 105.3.2 is amended to read as follows
105.3.2 Expiration of Plan Review. Applications for which no permit is issued within 180
days following the date of receipt of application shall expire by limitation, and plans and
other data submitted for review may thereafter be returned to the applicant or destroyed by
the building official. The building official may extend the time for action by the applicant for
a period not exceeding 180 calendar days on request by the applicant showing that
circumstances beyond the control of the applicant have prevented action from being taken.
No application shall be extended more than once, nor shall any extension be granted beyond
the last day of the current code cycle as adopted by the city of Eagle. In order to renew
action on an application after expiration, the applicant shall resubmit plans and pay a new
plan review fee.
