Box 1520 Phil Bandy Eagle, Idaho 83616 Steve Guerber January 7, 2008 939-6813 Scott Nordstrom Winding Creek Office Partners, LLC PO Box 2237 Eagle, ID 83616 RE: Expiration of Application#07-02-023 Dear Sirs: On December 21, 2006 the City of Eagle received an application for a commercial building permit on Lot 10, Block 1, Winding Creek East Subdivision; also known as 1275 E Winding Creek Drive; from Douglas B Clegg, Spring Creek Office, LLC. He was informed, by facsimile, on February 22, 2007 that the permit was ready and could be picked up with the required documents from Eagle Water Company, Eagle Sewer District and ACHD along with a City of Eagle signed Contractors Registration Verification Form. On July 24, 2007 we received a Copy of the Warranty Deed and a letter from Spring Creek Office, LLC transferring this parcel to your ownership and a $50 transfer fee for this application. Eagle City Code Section 7-IA-3 has amended the 2003 International Building Code Section 105.3.2, which allowed a 90 day extension, to be increased to a period of 180 Days to grant more flexibility to the build community when unforeseen conditions are presented. Since we have never been informed of the new builder information and a period of more than six (6) months has passed this application is deemed expired under the following: Eagle City Code Section 7-1A-3:IBC BUILDING CODE AMENDMENTS: IBC section 105.5 is amended to read as follows: IBC section 105.3.2 is amended to read as follows 105.3.2 Expiration of Plan Review. Applications for which no permit is issued within 180 days following the date of receipt of application shall expire by limitation, and plans and other data submitted for review may thereafter be returned to the applicant or destroyed by the building official. The building official may extend the time for action by the applicant for a period not exceeding 180 calendar days on request by the applicant showing that circumstances beyond the control of the applicant have prevented action from being taken. No application shall be extended more than once, nor shall any extension be granted beyond the last day of the current code cycle as K:\Building Dept\Expired permits\BP 07-02-023-1275E Winding Creek Drive.do adopted by the city of Eagle. In order to renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan review fee. The City of Eagle regrets that this project will not move forward.
