ORDINANCE NO. 591
AN ORDINANCE AMENDING EAGLE CITY CODE TITLE 1, "ADMINISTRATIVE",
CHAPTER 6, "CITY OFFICERS AND EMPLOYEES", SECTION lA "APPOINTMENT
OF OFFICERS", AND SECTION 2 "TERMS OF OFFICE, REMOVAL", AND SECTION
3 PROVIDING AN EFFECTIVE DATE.
THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO as follows:
Section: 1: 1-6-1: APPOINTMENT OF OFFICERS:
A. The mayor, with the consent of the city council, shall appoint a city clerk, city
treasurer, senior deputy city clerk/treasurer. deputy city clerk/treasurer. city
attorney, and such city en2ineer. police chief. other officers and supervisors. as may be
deemed necessary for the efficient operation ofthe city.
Section 2: 1-6-2: TERMS OF OFFICE, REMOVAL:
All appointive officers and supervisors shall hold office for the term for which they
were appointed and qualified; if a term is enumerated; provided, that any appointive
officer or supervisor may at any time be removed by the action of the mayor for any
reason deemed sufficient. but such removal shan be by and with the affirmative vote
of one half (1/2) plus one (1) of the members of the council holdinl!: office. or if there
is a vacancv in the council. by a maiority of those council members holdinl!: office:
provided that the council. by unanimous vote of all of its members may. upon their
own initiative. remove any appointive officer. supervisor. or emplovee. If an
appointive officer or supervisor has entered into an employment or similar
professional services al!:reement with the city that sets forth the method of
termination of said al!reement. said al!reement shan be followed in lieu of this
section of the Ea21e City Code. Nothin2 in this ordinance waives any benefits or
oblil!:ations an appointive officer. supervisor. or the City may have in the personnel
policv manual except to define the method of termination. with the concurrcncc of a
majority of the city council; provided further, that an employees holding positions
hy virtuc of appointment only, without the approval of the city council, may he
remo"/ed or discharged at the pleasure of the mayor. (Ord. 7)
Section 3: This Ordinance shall take effect and be in force from and after its passage,
approval, and publication as required by law. In lieu of publication of the entire
Ordinance, a summary thereof in compliance with Section 50-901 A, Idaho Code, may be
published.
