GRANT OF EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
For good and valuable consideration, the receipt of which is hereby
acknowledged, Grantor herein grants, bargains, sells and conveys to
Grantee that easement described as follows:
1. Grantor: Howell-Kiser Development Corporation, an Idaho
Corporation, whose address is POB 190718, Boise, Idaho 83719. .
2. Grantee: The City of Eagle, its officials, employees,
contractors and public safety agencies working with the City, (including
but not limited to fire, ambulance, rescue, police and sheriff); the
Department of Water Resources and Flood Control District No. 10.
3. Grantor's Property Subject to the Easement: That real
property in RiversEnd Subdivision No. 3 according to the official plat
thereof, Ada County Records" described as follows:
All of Common Area Lots 5, 24, 28 and 34, Block 1
The South Fifty (50) Feet of
Building Lots 26, 27, 29, 30, 32 and 33, Block 1;
Plus that portion of Lot 29, Block 1 lying south of the toe of
the levee along the south channel of the Boise River
4. Purpose of Easement; Non-Exclusive: The purpose of this
easement shall be for the ingress and egress to and from and along the
South channel of the Boise River for the purposes of flood control, Boise
River levee maintenance and public assistance emergencies on or in the
Boise River. This easement is non-exclusive and is not for the general
public.
5. Term of Easement; Runs with Land: The term of this
easement shall be perpetual and this easement shall run with the lands

described herein.
6. Successors; Assigns: The terms of this easement shall inure
to the benefit of and be binding on the personal representatives, heirs,
successors and assign~S ~f ~~ Grantor and Grantee herein.
