RESOLUTION No. 07-09
A RESOLUTION OF THE EAGLE CITY COUNCIL TO MOVE THE ACCESS AND
UTILITY EASEMENT SITUATED ON LOT I, BLOCK 3 (WELL LOT) WITHIN
LEXINGTON HILLS SUBDIVISION NO. I AS SHOWN ON THE ATTACHMENTS
HERETO AND ACCEPTING A NEW ACCESS EASEMENT SITUATED ON LOT 1,
BLOCK 3 WITHIN LEXINGTON HILLS SUBDIVISION NO.1 AS SHOWN ON THE
ATTACHMENTS HERETO, AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, The City of Eagle and the Lexington Hills Homeowners Association
mutually desire to relocate the existing access and utility easement located across Lot 1,
Block 3 (well lot) within Lexington Hills Subdivision No.1 for access to the City's well; and
WHEREAS, On March 27, 2007, the City Council recommended approval to relocate
the access and utility easement; and
WHEREAS, The City Council hereby finds that the proposed moving and relocating
of the access and utility easement complies in all respects with Idaho Code and the Eagle
City Code; and
WHEREAS, Exhibits A and B are attached hereto and are incorporated herein by
reference.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF EAGLE, Ada County, Idaho, as follows:.
Section 1: The Eagle City Council hereby moves the existing access and utility
easement on Lot 1, Block 3 (well lot) within Lexington Hills Subdivision No.1, as shown on
Exhibit B, and reestablishes the access and utility easement in a different location on Lot 1,
Block 3 (well lot) within Lexington Hills Subdivision No.1, as specifically described in
Exhibit A and as show on Exhibit B.
Section 2: The Eagle City Council hereby accepts from the Lexington Hills
Homeowners Association a twenty foot (20') wide permanent access and utility easement as
specifically described in Exhibit A and as shown on Exhibit B.
Section 3: This Resolution shall take effect and be in force from and after its passage
and approval.

A parcel of land situated in Lot I, Block 3, Lexington Hills Subdivision No.1, filed at
Instrument No. 9209136, Book 59 Page 5802 of plats, records of Ada County, Idaho, in the
SWl/4 of Section 3, Township 4 North, Range 1 East, Boise Meridian, Ada County, being more
particularly described as follows:
Commencing at the northwest corner of Lot 1 Block 3;
thence along the westerly line of said Lot 1 S04017'30"E 135.71 feet to the POINT OF
BEGINNING;
thence at right angles N85042'30"E 85.48 feet to the cusp of a CUNe concave southeasterly
on the northerly side of Lot 2, Block 3, from which a radial line bears S04017'30"E 50.00 feet,
delta angle of 53007'48" and a long chord of S59008'36'W 44.72 feet;
thence southwesterly along said Lot 2, 46.36 feet;
thence at right angles to previously mentioned westerly line S85042'30'W 46.15 feet to the
west line of said Lot 1 and a non-tangent point on a CUNe concave westerly, having a radius of
170.00 feet, delta angle of 05004'41", and a long chord of NOI045'09'W 15.06 feet;
thence northerly along said CUNe 15.07 feet, along said west line;
thence N04017'30'W 4.95 feet, along said west line, to the POINT OF BEGINNING.
