Resolution - 2007 - 13 - Support And Participate In The Development Of Adequate Public Facilities Ordinances/Land Use/Transportation - 06/26/2007 CITY OF EAGLE RESOLUTION NO. 07-13 A RESOLUTION TO SUPPORT AND PARTICIPATE IN THE DEVELOPMENT OF ADEQUATE PUBLIC FACILITIES ORDINANCES SPECIFICALLY INCLUDING THOSE FOR LAND USE AND TRANSPORTATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Ada County ("County"), the Ada County Highway District CACHD") and the City of Eagle ("City"), and the Idaho Transportation Department ("ITD") executed a letter of intent on April 19, 2004 and entered into an Intergovernmental Agreement on August 10,2004 ('IGA") to commence a regional multi-jurisdictional effort to engage in a two phase countywide land use and transportation planning and implementation process ("Blueprint for Good Growth or BGG"); and WHEREAS, the IGA established a Consortium of Members Agencies, ajoint Technical and Steering Committee consisting of representative of the Member Agencies, COMPASS, and other community stakeholders; and WHEREAS, the Consortium and Technical and Steering Committees approved the adoption of the BGG Phase I on or about September 14, 2006 which establishes the overall framework for growth management in Ada County; and WHEREAS, , the City has not, nor does it intend to adopt BGG Phase I; and WHEREAS, on or about December 10, 2006, the Consortium conditionally approved the implementation of the BGG phase II, including the development of adequate public facilities ("APF") requirements, policies and strategies that are intended to be considered for incorporation into the plans, regulations and ordinances of the Member Agencies and ITD; and WHEREFORE, as set forth in letters to the Consortium dated April 2, 2007, and April 24, 2007, the City of Eagle has determined that it is in the best interests of the City to not continue to participate in the APF within the BGG Phase II; NOW, THEREFORE, BE IT RESOLVED, that as described in the recitals herein, the City of Eagle hereby approves the City's continued participation in BGG Phase II without committing its public funds or formally endorsing the results of BGG Phase II which results may be incorporated into the City's plans, regulations and ordinances as the City, at the Eagle City Council's sole discretion, deems appropriate and in the public interest; and BE IT FURTHER RESOLVED, pursuant to Idaho Code 967-2328, the City of Eagle may consider adoption of a Second Intergovernmental Agreement if consistent with this Resolution or as otherwise may be determined by the Eagle City Council.
