RESOLUTION NO. 07-23 A RESOLUTION OF THE CITY OF EAGLE, IDAHO, TO V ACA TE PORTIONS OF LOT 3, BLOCK 2 (P A THW A Y LOT) WITHIN EAGLE RANCH SUBDIVISION NO. 4A, AS SHOWN ON THE ATTACHMENTS HERETO AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Eagle Ranch Subdivision No. 4A was platted and accepted by the city of Eagle on March 4, 1978; and WHEREAS, Lot 3 is owned by the City of Eagle and is used for pedestrian and bicycle use and is therefore considered a public right-of-way; and WHEREAS, The purpose of the vacation is to relinquish interest in portions of the pathway lot that are no longer needed for public use; and WHEREAS, On July 24,2007, the City Council approved the vacation of portions of the pathway lot; and WHEREAS, Exhibits A, B, C, D, and E are attached hereto and are incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, Ada County, Idaho, as follows: Section 1: The City Council for the City of Eagle hereby vacates portions of the existing pathway lot within Eagle Ranch Subdivision No. 4A shown as Area 2, Area 3, and Area 4 on Exhibit E and as specifically described in Exhibits B, C, and D. Exhibit A specifically describes that portion of Lot 3 that the City of Eagle will retain ownership. Section 2: This Resolution shall take effect and be in force from and after its passage and approval. DATED this 24th day of July, 2007.
