RESOLUTION NO. 07-20
A RESOLUTION OF THE CITY OF EAGLE, IDAHO, TO V ACA TE THE ACCESS AND
UTILITY EASEMENT SITUATED ON LOTS 2, 3, AND 4, BLOCK 4, WITHIN MERRILL
SUBDIVISION NO.2 AS SHOWN ON THE ATTACHMENTS HERETO, AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, Merrill Subdivision #2 was platted and accepted by the City of Eagle on June
8, 1999; and
WHEREAS, On May 7, 2007, the Commission passed a motion recommending approval of
the vacation (V AC-O 1-07), to the Council; and
WHEREAS, On June 12, 2007, the City Council approved vacation application (V AC-O 1-
07) for the vacation of the access and utility easement located on portions of Lots 2, 3, and 4, Block
No.4, Merrill Subdivision No.2; and
WHEREAS, On June 12,2007, the City Council held a public hearing on the proposed
vacation (V AC-01-07) and voted to approve the vacation; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Sections
9-6-2 of Eagle City Code, "Vacations and Dedications"; and
WHEREAS, Exhibits A and B are attached hereto and are incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
CITY OF EAGLE, Ada County, Idaho, as follows:
Section I: The City Council for the City of Eagle hereby vacates the existing access and
utility easement on portions of Lots 2, 3, and 4, Block 4, within Merrill Subdivision No.2, as shown
on Exhibit A and as specifically described in Exhibit B.
Section 2: This Resolution shall take effect and be in force from and after its passage and
approval.
