The above-entitled design review application came before the Eagle Design Review Board for their action
on March 8,2007. The Board continued the item to March 22, 2007, and to April 12, 2007. Due to a lack
of quorum on April 12, 2007, this item was reviewed by the Board on April 26, 2007. The Design Review
Board having heard and taken oral and written testimony, and having duly considered the matter, makes
the following Findings of Fact and Conclusions of Law;
FINDINGS OF FACT:
A. PROJECT SUMMARY:
Gale Pooley is requesting design review approval of a master sign plan for a multi-tenant office
building. The 0.18-acre site is located on the south side of Winding Creek Drive
approximately 430-feet west of Hill Road at 979 Winding Creek Drive.
B. APPLICA TION SUBMITTAL:
The City of Eagle received the application for this item on February 7, 2007.
C. HISTORY OF RELEVANT PREVIOUS ACTIONS: None

STAFF ANALYSIS PROVIDED WITHIN THE STAFF REPORT:
A. COMPREHENSIVE PLAN PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING
THIS PROPOSAL:
· Protect and enhance the small town character of the City by requiring signage which is creative
and distinctive, compatible with its surroundings, and an integral component of the style and
character of the building to which it relates.
B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS
PROPOSAL:
· Eagle City Code Section 8-2A-2(B)
The general theme of the Design Review Overlay District is to specifY desirable building and
landscape architectural styles and materials to create a sustainable and pleasing environment
for residents and visitors alike. The architectural designs, materials, and graphics set forth in
this article are complied to create a theme unique to the area called "Eagle Architecture".
· Eagle City Code Section 8-2A-6(A)(4)
Signage for any project shall provide for business identification and minimize clutter and
confusion on and off the site.

Signs are to provide effective and necessary business identification systems adapted to the
building design.

The size, location, design, color, texture, lighting, landscaping, and hours of operations of all
permanent signs and outdoor advertising structures or features to insure that any such
proposals do not detract from the function of, or design of, buildings, structures, surrounding
properties, neighborhoods, or streets.

Sign materials and overall appearance shall compliment the building architecture and colors as
determined by the Design Review Board.

Any business within a multitenant building that is located on a street comer or which fronts
two (2) streets shall be allowed two (2) wall signs. The sides of the building on which the
signs are to be placed shall be shown by the owner, but shall be as approved by the design
review board.
· Eagle City Code Section 8-2A-8(C)(4)(c)
The total area of any wall sign attached parallel to, or painted on the face of a building shall
not exceed ten percent (10%) of the total area of the building face to which it is attached or
painted
· Eagle City Code Section 8-2A-8(C)(5)(d)
A freestanding single tenant building, not in a shopping center, shall be permitted to construct,
erect and maintain one monument sign per street that it abuts to identifY the business to which
it pertains. The exposed surface of any such sign shall not exceed fifty (50) square feet per
exposed surface except that the exposed surface of any such sign within forty feet (40') of a
building shall not exceed six feet (6') in height and thirty (30) square feet per exposed surface.
· Eagle City Code Section 8-2A-8(C)(8)
Freehanging Signboards: Freehanging signboards attached under covered porches or canopies,
are permitted, but no such sign may exceed eight (8) square feet nor shall any such sign extend
beyond the porch or canopy to which it is attached. A minimum distance of seven feet six
inches (7'6") shall be required between a walkway and the bottom of a freehanging signboard.
· Eagle City Code Section 8-2A-8(K)(I)
No signs shall be erected or maintained in any district as established by the Zoning Ordinance
except those signs specifically enumerated in this Chapter. The number and area of signs as
outlined in this Chapter are intended to be maximum standards which do not necessarily
ensure architectural compatibility. Therefore, in addition to the enumerated standards,
consideration shall be given to a sign's relationship to the overall appearance of the subject
property as well as the surrounding community. Compatible design, simplicity and sign
effectiveness are to be used in establishing guidelines for sign approval.
C. DISCUSSION:
· The applicant is requesting approval of a master sign plan for this multi-tenant office building.
Two building wall signs are proposed to be located on the south building elevation, one over
each tenant entrance. One sign with two tenant panels is proposed to be located on the east
building elevation. Per Eagle City Code, any business within a multi-tenant building that is
located on a street comer or which fronts two (2) streets shall be allowed two (2) wall signs.
Although this building is a multi-tenant office building, it is not located on a street comer nor
does it front two (2) streets. Thus, per Eagle City Code the applicant would only be permitted
to have building wall signs on one building elevation. The applicant has elected to not
construct a monument sign along East Winding Creek Drive and would like approval to
construct one sign with two tenant panels to be installed on the east building elevation
(adjacent to the driveway providing access to the site). Staff has included the building wall
sign proposed on the east building elevation within the master sign plan criteria noted below,
however, if the Board or City Council do not concur that a building wall sign should be
constructed on the east building elevation, the master sign plan criteria will need to be
modified to reflect such changes.

· The size of the building wall sign with two tenant panels proposed on the east building
exceeds that which is permitted by Code. The applicant is proposing a thirty (30) square foot
building wall sign on the east building elevation. Per Eagle City Code, the total area of any
sign attached parallel to the face of the building may not exceed ten percent (10%) of the total
area of the building face to which it is attached. The applicant should be required to provide a
revised sign detail of the east building wall sign showing the sign does not exceed twenty six
(26) square feet, which is permitted within Eagle City Code. The revised sign detail should be
reviewed and approved by staff prior to the City issuing a sign permit for this site.
· Staff recommends the following criteria for the "Master Sign Plan Criteria for 979 East
Winding Creek Drive".
Master Sign Plan Criteria
for 979 East Winding Creek Drive
1. Each tenant shall be required to submit signage plans to the building's managing
entity for written approval. A design review sign application, accompanied by the
written approval of the managing entity, shall be submitted to the City for any
proposed signs for City staff review and approval. All signs shall be in compliance
with the criteria stated herein as well as Eagle City Code. In cases of any conflict
between Eagle City Code and the criteria specified herein, the more restrictive
requirements shall apply.
2. Sign areas shall not exceed six (6) square feet on the south building elevation. A
minimum distance of seven feet six inches (7' 6") shall be required between the
walkway and the bottom of the sign.
3. The sign area shall not exceed twenty six (26) square feet for both tenant signs on the
east building elevation.
4. Signs shall be non-illuminated.
5. A one (I) square foot logo is permitted.
6. The back ground color of all signs shall be Cobblestone to match the color of the
columns on the south building elevation.
7. The tenant text shall be ';4" thick minimum mounted flush to the face of the sign.
8. Tenants shall use earth tone colors for their font and logo in a flat or matte finish. No
glossy paints, vinyl, or plexi-glass is permitted.
9. Tenant signs shall be located within the designated areas shown on the attached
elevation plans date stamped by the City on February 7, 2007.
10. No monument sign is permitted.
11. Any other signage such as temporary grand opening, etc. shall comply with Eagle City
Code.
12. Any signage on doors or windows shall comply with Eagle City Code.
13. Upon termination of their lease, the tenant sign shall be removed.
· Staff defers comment regarding design and color of all proposed signs to the Design Review
Board.

STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT:
Based upon the information provided to staff to date, staff recommends approval with the site
specific conditions of approval and the standard conditions of approval provided within the staff
report.
PUBLIC MEETING OF THE BOARD:
A. A meeting was held on the application before the Design Review Board on March 8, 2007. The
application was continued to March 22, 2007, and April 12,2007. Due to a lack of quorum on April
12,2007, this item was reviewed by the Board on April 26, 2007, and made their decision.
B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one.
C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not
including the applicant/representative).
BOARD DECISION:
The Board voted 4 to 2 (Barnes and Wright against, Weber absent) to deny DR-05-07 for a design
review application of a master sign plan for a multi-tenant office building for Gale Pooley. The
application was denied based on the applicant not complying with all the changes to the building
requested by the Design Review Board.
CONCLUSIONS OF LAW:
1. The application for this item was received by the City of Eagle on February 7, 2007.
2. The Board reviewed the particular facts and circumstances of this proposed design review application
(DR-04-06) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review
Overlay District, and based upon the information provided with the conditions required herein,
concludes that the proposed design review application is in accordance with the Eagle City Code and
the Eagle Comprehensive Plan, however, because the application for the building was not approved,
the Board did not approve the master sign plan associated with the building.
