February 27, 2007
PRE-COUNCIL AGENDA: 6:30 p.m. - 7:30 p.m.
]. Eagle Police Department: Monthly report by Chief Borgquist.
Reports\ on a meeting with Rob Brezie, Fish and Game Department. The Fish and Game
Department would like to negotiate the hunting issue in order to allow some hunting in certain
sections. One of the areas that would be open for hunting would be behind the Eagle Sewer
District facility. General discussion.
Council is recommending that the Eagle Police Department enforce the City Code, no
discharging of firearms in the City Limits.
Chief Borgquist: Distributes the Year End Report and discusses the same. General discussion.
Public Works Director Milan: Distributes a Project Submittal Summary for the Neighborhood
Reinvestment Program and Recommended Project Subject and discusses today's committee
meeting. The Committee has narrowed the applications down to four requests. General
discussion. Discussion on revamping the criteria and the guidelines for the program.
Reports on the progress at Guerber Park. The Park should be completed about the middle of
April. Discussion on the electrical connections for the water feature and the electrical
inspection. General discussion.
The pump test was completed for the Brookwood Well and it didn't seem to draw down the
neighboring wells. Chase's would not allow us on their property to test their well.
I am meeting with Trautman's on March 7th to negotiate the amendment to their contract.
I have a weekly report from Vern Brewer on the progress with the water storage tank and the
improvements to the water system. Discussion on the bidding process for the storage tank. The
projected completion date is in November.
General discussion on the Master Plan for Parks and Pathways. Council concurs to use some of
the funds set aside for the skateboard park repairs to hire a consultant.

4. PUBLIC COMMENT: Jason Pierce: Reports on the Committee for the Downtown. We
would like to be on the Council agenda in May.
5. CONSENT AGENDA:
· Consent Agenda items are considered to be routine and are acted on with one
motion. There will be no separate discussion on these items unless the Mayor, a
Councilmember, member of City Staff, or a citizen requests an item to be removed

Mark Butler with Land Consultants, Inc., is requesting approval of an annexation
and a rezone from RUT (Rural Urban Transition) to MU-DA (Mixed Use with a
Development Agreement), and preliminary plat approval for The Lofts at Eagle
River, an 8 lot (7-residential, I-common), 214-unit multi-family
condominium/townhouse housing development. The 25.37-acre site is located on
the south side of East Riverside Drive approximately 1500 feet west of the
intersection of East Riverside Drive and State Highway 44 at 827 East Riverside
Drive.
D. Findinl!s of Fact and Conclusions of Law for CU-05-06 - Conditional Use
for a Heil!ht Exception for Townhouses/Condominiums within The Lofts at
Eal!le River - Sea 2 Sea. LLC: Sea 2 Sea, LLC, represented by Mark Butler
with Land Consultants, Inc., is requesting conditional use approval for a height
exception of 49 feet, 2 v.. inches for condominiums and 36 feet, 7 inches for
townhouses within the Lofts at Eagle River residential development. The 25.37-
acre site is located on E. Riverside Drive approximately 1500 feet west of
Edgewood Lane at 827 E. Riverside Drive.
E. Findinl!s of Fact and Conclusions of Law for FPUD-03-06 & FP-I0-06 &
FPUD-4-06 & FP-ll-06 - Final Development Plan and Final Plat for
Eal!lefield Estates Subdivision Phases 1 & 2 - Eal!lefield, LLC: Eaglefield,
LLC, represented by John Carpenter, PE with Landmark Engineering and
Planning, Inc., is requesting final development plan and final plat approval for
Eaglefield Estates Phase I, a 39.3-acre, 135-lot (I16-buildable, 19-common)
residential subdivision and Eaglefield Estates Phase 2, a 61.8-acre, l30-lot (112-
buildable, l7-commom, I-well lot) residential subdivision. The entire Eaglefield
Estates Subdivision is located on the north side of State Highway 44
approximately 650-feet west of Linder Road.
F. Findinl!s of Fact and Conclusions of Law for CU-I0-06 - Conditional Use
Approval for a Bank Facilitv With Drive-Up Service - Eal!le River: Eagle
River, represented by Billy Ray Strite with BRS Architects, is requesting
conditional use approval to construct a bank facility with two drive-up service
lanes. The .93 acre site is located within Eagle River at the southeast corner of
South Eagle Road and East Riverside Drive at 47 East Riverside Drive.
G. Findinl!s of Fact and Conclusions of Law for CU-ll-06 - Conditional Use
Approval for a Childcare and Elementarv School Facilitv - Genesis One.
LLC: Genesis One, LLC, represented by Travis Burrows with Dave Evans
Construction, is requesting conditional use approval for a 4,200-square foot
childcare facility and elementary school. The 0.33-acre site is located on the

south side of East Iron Eagle Drive, approximately 'I. mile west of Edgewood

H. Findinl!s of Fact and Conclusions of Law for RZ-22-06 - Rezone from A-R
to R-E-DA - John Johnston: John Johnston, represented by Doug Russell,
ASLA with The Land Group, Inc., is requesting approval of a rezone from A-R
(Agricultural-Residential) to R-E-DA (Residential-Estates with development
agreement). The 4.74-acre site is located on the southeast corner of North
Beverly Drive and Floating Feather Road at 1200 North Beverly Drive.
I. Findinl!s of Fact and Conclusions of Law for RZ-23-06 & A-17-06-
Annexation and Rezone from RUT to R-E-DA - Dave Callister: Dave
Callister, represented by Penelope L. Riley, is requesting approval of an
annexation and a rezone from RUT (Rural Urban Transition) to R-E-DA
(Residential Estates with a development agreement). The I 8.85-acre site is
located on North Meridian Road between Beacon Light and Floating Feather
Road at 2650 North Meridian Road and 2421 North Meridian Road.

Linda Butler, representing the Arts Commission. I have met with City Attorney and we have
made some changes and clarified some language so there would be less confusion. General
discussion.
Discussion on the Market Chef who cooks at the market. He has a radio show and he will begin
to advertise our market on his show.

D. Report on Urban Renewal Al!encv Meetinl!. (NM)
Mayor introduces the issue.
Jason Pierce, reports on the Urban Renewal Agency Meeting that was held today. There was an
election of officers. The work that is being down by the Chamber for the downtown area will be
presented to the Agency for review. Discussion on how the City and the Agency will work
together. Their regular meeting schedule will be on the 151 Wednesday of the Month and will

meet at City Hall. At a future date there will be a meeting with the property owners in the areas.
General discussion.
E. Discussion of Transportation Committee establishment, duties. and meetinl! dates. (NM)
Mayor introduces the issue. I am ready to send information to the paper on recruiting members
for the Committee.

8. NEW BUSINESS:
A. Review ofHV/AC Maintenance Proposals: (ME)
Mayor introduces the issue.
Mike Echeita, Facilities Manager, discussion on the maintenance proposals for the HV AC
systems. Cox Mechanical has submitted the low proposal and they are also the company that
installed the equipment. My recommendation is Cox Mechanical. General discussion.
Nordstrom moves to approve the proposal from Cox Mechanical to service the HV AC
systems for City Hall for the next year. Seconded by Bandy. Discussion. Bastian: AYE;

B. #200600230-Z0A - Ada County Zoninl! Ordinance Amendment: Ada County Zoning
Ordinance Amendment to increase the maximum lot coverage from five (5%) to twenty percent
(20%) in the rural and residential base districts. (WEV)
Mayor introduces the issue.
Zoning Administrator Vaughan: This is an Ada County Transmittal. Provides Council an
overview of the Zoning Ordinance Amendment. We have recommended denial. Discussion on
Eagle City Code in regards to riding arenas. General discussion.
C.J. Thompson, discussion on Conditional Use Permits on these types of issues. We need to
proceed with caution especially on development in the foothills. General discussion.
Nordstrom moves to ask the Zoning Administrator to respond and expand on our
discussion here tonight and the City's concerns. Seconded by Bastian. Discussion. ALL

The Zoning Administrator will distribute a copy of the letter to the County to the Mayor and
Council.
9. WORK SESSION:
Mayor introduces the issue. I don't have anything for a work session tonight.
City Attorney Report: No report
Zoning Administrator's Report: Discussion on monthly meetings with the Sewer District.
Bastian: I have some concerns about a 20' set backs for backyards. I think it should be 25' set
back. General discussion.
City Clerk/Treasurer Report: I have provided you a memo on my meeting with Craig Hildebrand
on the expansion of City Hall. Discussion on future staff needs for the City. General discussion
on staff work load.
Discussion on lot inventory and building permits. Design Review Applications are up from last
year.

We have a request from a company called The Terra Firm that are working on a relocation
magazine for the Chamber of Commerce to use the City Logo. General discussion. Council
concurs to allow the use of the City Logo with prior review of the use of the logo.
Discussion on a bond issue for expansion and payment of the City Hall.
Mavor and Council's Report:
Nordstrom: No report.
Guerber: Report on the meeting between the Eagle and Star Fire District. There is talk on
consolidation of the districts. They are also looking at locations for future Fire Department
Stations.
I had a meeting with the Echo Creek Homeowner's Association in regards to the Veledrome.
They support the project now that they understand what the project entails.
Reports on the Eagle Fun Days meetings. The only new thing is a classic car show and an
evening street dance on Friday night in the Library parking lot. The Statesman is going to do an
insert this year. We are also doing some sponsorship.
Bastian: No report
Mayor: Discussion on the State Street Corridor Study.
Stan made a beautiful motion at the Legislature and we were able to secure the funding for the
bridge at Eagle Island State Park.
Discussion the impacts that the Fraiser case has had on leasing.
I have requested that we don't have a meeting in March with ACHD.
Discussion on the Kastera letter pulling their request for annexation in the City of Eagle.
We have a request for the volleyball court at Merrill Park to be improved.
Mercy Housing has called and they are looking at a Grant that would allow people to buy their
mobile homes instead of leasing them. General discussion.
Reports on the Mayor's Youth Committee. Discussion on the March for Meth.
Discussion on the Healing Fields project. The Kiwanis want to do the parade. We have had a lot
of people in the community asking to be involved.
I won't be at the next meeting, I will be at the National League of Cities. We are taking two boys
on the Mayor's Youth Committee and Theresa is going as their chaperon.
Further discussion on the push against Meth. Discussion on Drug Court.
Discussion on burying Idaho Power lines.
Guerber: It was my understanding that when we dropped our lawsuit ITD on the bypass that we
were to have meetings on access to the bypass. General discussion.

Calls for Service in 2005.
