A RESOLUTION OF THE EAGLE CITY COUNCIL ESTABLISHING A POLICY TO
REQUIRE THE APPLICANT OF ANNEXATION APPLICATION PROPERTIES WHICH
ARE 500 ACRES OR LARGER IN SIZE TO PREPARE AND MAIL THE REQUIRED
PUBLIC HEARING NOTIFICAITONS TO ALL PROPERTY OWNERS WITHIN THE CITY;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on December 10, 2019, the Eagle City Council adopted Ordinance 820
which requires public hearing notification by direct mail to all property owners within the City
for annexation applications which are 500-acres in size or larger; and
WHEREAS, the Mayor and City Council of the City of Eagle, Idaho ("City") have
determined that it is appropriate to establish a policy to require the applicant of an annexation
application for property which is 500-acres or larger in size to prepare and mail, at the
applicant's own cost, the required public hearing notices to all property owners within the City;
and
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO.
Section 1: The Eagle City Council hereby adopts the policy to require the applicant of an
annexation application for property which is 500-acres or larger in size to prepare and mail, at
the applicant's own cost, the required public hearing notices to all property owners within the
City. The applicant shall provide to the City a list of all notified property owners and a signed
affidavit certifying compliance with the notification requirements of Ordinance 820 no later than
fifteen (15) days prior to the public hearing.
Section 2: This resolution shall be in full force and effect immediately upon its adoption
and approval.
ADOPTED by the Council of the City of Eagle, Idaho, this 18th day of December, 2019.
