ROLL CALL: Present: WRIGHT, GUERBER, MCLAUGHLIN, and SMITH. Absent: JOHNSON. A quorum is present. ALL CONSENT AGENDA ITEMS ARE ACTION ITEMS. CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of November 18, 2019. McLaughlin moves to approve the consent agenda as presented. Seconded by Smith. ALL AYES... MOTION CARRIES. 4. UNFINISHED BUSINESS: NONE. PUBLIC HEARINGS: A. ACTION ITEM.- CU -06-19 — Outdoor Preschool and Nursery Plant Materials) and Waivers Pursuant to Idaho Code 67-6512 — Tamara Jahelka & Miranda Deckwa Jasper: Tamara Jahelka and Miranda Deckwa Jasper are requesting conditional use pennit approval for a 24- student (maximum) outdoor preschool (daycare center), a nursery (plant materials), and waivers pursuant to Idaho Code 67-6512(f). The 1.41 -acre site (Lots 12 & 13, Block 2, Randall Acres Subdivision No. 15) is located on the north side of East Dunyon Street approximately 320 -feet west of the intersection of North Parkinson Street and East Dunyon Street at 2230 and 2248 East Dunyon Street. Miranda Deckwa Jasper and Tamara Jahelka, 2230 and 2248 East Dunyon Street. The applicants provide an overview of the application. Deckwa and Jahelka respond to questions from the Commission. City Planner, Denise Lauerman, provides a detailed overview of the application. Lauerman responds to questions from the Commission. Chairman Wright opens the Public Hearing. Lisa Stoner, 897 South Parkinson Street. Stoner states that her properties abut the application property and expresses concerns regarding activities currently taking place on the property, the proposed daycare, and the amount of noise and traffic being generated on the subject properties. Stoner discusses disruptions to the peace and quiet of the neighborhood, her history living on the property, and her right to quiet and privacy. Stoner states that the area is a residential area and she wants the area to remain as it is, states that she does not want traffic parked on the street, or people walking around on the lot next to hers and violating her privacy. Stoner expresses concerns about traffic generated by the proposed uses, describes a conversation he had with the Ada County Highway District (ACRD) regarding traffic counts, and describes locations of commercial properties in the surrounding area. Stoner expresses concerns regarding the safety of a daycare operating in close proximity to surrounding neighbors' dogs. Stoner expresses additional concerns about traffic, explains the different types of housing in the neighborhood, and states that the proposed uses are unwanted uses in the area. Mr. Stoner responds to questions from the Commission. Deckwa and Jahelka provide rebuttal and respond to concerns raised during the Public Hearing. Chairman Wright closes the Public Hearing. General discussion amongst the Commission. Smith moves to recommend for approval CU -06-19 Outdoor Preschool and Nursery and Waivers Pursuant to Idaho Code 67-6512(f) with the following conditions: that item #8 was to be stricken, and on #10, the numbers change from 5% to 3% and from 8 to 5. Seconded by Guerber for further discussion. Zoning Administrator, Bill Vaughan, requests clarification regarding the motion. Discussion amongst the Commission. Guerber proposes a substitute motion to strike items 8 and 10, and to adjust the required fencing to the Spring of 2021. Discussion amongst the Commission. Substitute motion seconded by Smith.
