TERMINATION OF EMERGENCY A CESS EASEMENT
This instrument is made and entered into by the City of Eagle (the "City") on the date of
the City's execution for the purpose of terminating that certain Emergency Access Easement
Agreement,recorded as Instrument No.2015403506,records Ada County,Idaho(the"Easement
Agreement").
Recitals
A. Brahma, LLC, an Idaho limited liability company ("Brahma"), and Legacy
Community Association, Inc., an Idaho non-profit corporation, granted that certain
emergency access easement upon terms and conditions specifically set forth in the
Easement Agreement.
B. Brahma and affiliated developers, White Sturgeon, LLC and North Corridor, LLC,
have platted subdivision phases, namely Snoqualmie Falls Subdivision No. 7,
Snoqualmie Falls Subdivision No. 10, Snoqualmie Falls Subdivision No. 11, and
Snoqualmie Falls Subdivision No. 12, and will record a plat for Snoqualmie Falls
Subdivision No. 13, pursuant to the City approved plat for Snoqualmie Falls
Subdivision No. 13. The foregoing phases are collectively referred to as the "Access
Easement Phases." The plats of all Access Easement Phases are recorded with the
Ada County, Idaho recorder's office, excepting the plat for Snoqualmie Falls
Subdivision No. 13,which shall be recorded in the Ada County,Idaho recorder's office.
C. As part of the construction of the Access Easement Phases,the City,through the City's
fire department, has determined that the emergency access created in the Easement
Agreement is no longer required,there being sufficient secondary access for the Access
Easement Phases to Palmer Ln. over a gravel constructed roadway contiguous to the
Middleton Mill Canal on its southern boundary.
NOW, THEREFORE, for good and valuable consideration, including the recitals, set
forth above, the City for and on behalf of all emergency services providers hereby
terminates the Easement Agreement and releases any and all right, title and interest in the
emergency access easement created in said Easement Agreement.
