A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE UTILITY, DRAINAGE, AND
IRRIGATION EASEMENTS BETWEEN LOTS 7 & 8, 7 &10,10 & 11, 10 & 13, 13 & 14, AND 13 & !i;

HERETO; AND PROVIDING AN EFFECTIVE DATE. cC
WHEREAS, Grant N. Lee, Joyce M. Lee, Douglas L. Swenson, and Suzann Swenson requested a c>
vacation to the final plat of Rivervine Subdivision No. 1 to remove the utility, drainage, and irrigation ~
easements between Lots 7 & 8, 7 &10, 10 & 11, 10 & 13, 13 & 14, and 13 & 15, Block 1 (Rivervine ~
Subdivision No.1); and
WHEREAS, On January 8, 2007, the Commission recommended approval of the vacation (V AC-
03-06), with conditions, to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in the The
Valley Times on January 8, 2007, and January 15,2007; and
WHEREAS, On January 23, 2007, the City Council held a public hearing on the proposed
vacation (V AC-03-06), and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A ofthe Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates the utility, drainage, and irrigation easements centered on
the lot lines between Lots 7 & 8, 7 &10, 10 & 11, 10 & 13, 13 & 14, and 13 & 15 Block 1 of the final plat
of Rivervine Subdivision No.1, as considered, heard and approved by the Council at its January 23,2007,
public hearing for application number V AC-03-06 and as shown on the attachments hereto (Exhibit A).
This Resolution shall be in full force and effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho, this 13th day of February, 2007.
