A RESOLUTION OF THE EAGLE CITY COUNCIL TO V ACA TE THE "INGRESS/EGRESS
EASEMENT" ON LOT 4, BLOCK 1 (PLAT NOTE NUMBER 1) ON MERRILL
SUBDIVISION NO.5, AS SHOWN ON THE ATTACHMENTS HERETO; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, Wm. Dave Evans requested a vacation to the final plat of Merrill
Subdivision No. 5 to remove the "Ingress/Egress" plat note relating to (Lot 4, Block 1) so that
said lot may become a buildable lot; and
and
WHEREAS, The mixed use subdivision consists of 9 buildable lots, and 1 common lot;
WHEREAS, The 8,215 square foot site is located at 1205 East Iron Eagle Drive within
Rocky Mountain Business Park; and
WHEREAS, On January 8, 2007, the Commission passed a motion recommending
approval of the vacation (V AC-02-06), with conditions, to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in
the Valley Times on January 8, 2007, and January 15,2007; and
WHEREAS, On January 23, 2007, the City Council held a public hearing on the proposed
vacation (V AC-02-06), and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section
9-6-2 of Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO.
The Eagle City Council hereby vacates the plat note for the "Ingress/Egress" on Lot 4,
Block 1, of the final plat of Merrill Subdivision No.5, as considered, heard and approved by the
Council at its January 23,2007, public hearing and as shown on the attachments hereto.
This Resolution shall be in full force and effect immediately upon its adoption and
approval.
