Minutes - 2006 - City Council - 11/21/2006 - Regular ,,/ EAGLE CITY COUNCIL Minutes November 21, 2006 *Early Start Time for Pre-Council * PRE-COUNCIL AGENDA: 6:00 p.m. - 7:30 p.m. Council President Bastian will preside over the meeting in the absence of the Mayor. Council President Bastian: I understand Mike Mongelli has some introductions. Mike Mongelli, Building Official: Introduces Tom Preston, our new plumbing inspector, and Terry Schriver, our new electrical inspection. General discussion. A. Treasure VaUev Air Ouality Council: Review of study of the state of air pollution in the Valley and possible solutions to be considered. Rick Stot, member of the Air Quality Council, introduces Rick Yzaguirre, Ada County Commissioner, and the small business representative. Rick presents a power point presentation for the Council on Treasurer Valley Air Quality Council, Together, Making a Visible Difference. General discussion on air quality in the valley. B. Eal!le Sewer District: Presentation of Master Plan. Lynne Sedlacek, Office Manager Eagle Sewer District, also with me are Lynn Moser, Manager of Eagle Sewer District, provide the Council an update on the extensive plan that we have done and will be doing. Provides an overview of the operations of the Eagle Sewer District. Discusses implementing new technology. We will be having public open houses. Discussion on the reuse option. We need to have this as ajoint effort with the City and we encourage the Council to attend some of the public meetings. This will probably impact rates but the Sewer District has not increased rates in ten years. General discussion. Cindy Brunts, MWH, the facility plan we expect to complete in spring 2007 and then we will move on to pre-design. If everything goes smoothly we would be operating a plant in 20 I O. General discussion. Further general discussion on the expansion plans of the Eagle Sewer District. C. Mark Bowman, Detective with the City of Eagle, I want to introduce Nick Lippret who has been very honest and forthcoming with me. Nick has signed the Juvenile Behavior Agreement tonight which is good for one year. There are three items, pay the cost of the bench, appear before the City Council and have no violations. Nick Lippret apologizes for breaking the bench in Heritage Park. It was something that I should not have done and I have paid the costs for the bench. General discussion. Council thanks Nick for coming forward. Mayor is in attendance at 7:00 p.m. and conducts the remainder of the meeting. REPORTS: City Engineer, Vern Brewer, the drilling process is being started on the Brookwood well; it should be done in about 30 days. December 6th through the 8th is the water rights hearing. City Attorney, Susan Buxton: we have been working on several things. We have met with A vimor and M3 in regards to financing. I have had several meeting with the Triple Ridge people. General discussion on foothills developing and financing. General discussion. City Clerk Bergmann, I have completed the new budget fonnat and Bill, Mike and I have met and they are reviewing the fonnat. We will be operating under the new fonnat the rest of the year so you will see this new fonnat at Budget Time. Mayor: I would like Council Member Nordstrom to review this new format also. The City Clerk's have completed the model Records Retention Manual and I am now revising the manual to fit the City of Eagle. Adoption of the City's Record Retention Manual will be on a Council meeting in December. Your meeting on November 28th will have a small agenda. There will be a resolution on the agenda in regards to Urban Renewal. General discussion. The applicant was unable to make the meeting tonight as he is out of town. Jeff Cline, representing part of the people in the Covenant Hills Subdivision expressed concern to the Mayor's Office about the scheduling during December 12th and the holiday season, Thanksgiving and Christmas. They had all of their folks ready for last weeks hearing and due to the proximity of time to Christmas, there were quite a few folks who were unable to attend. I discussed the application with the Mayor, we called the applicant to see ifhe could make it on December 5th ifnot it would need to be continued to January. It is your decision to have it on December 5, 2006 or January 29, 2007. . The hearing dates in January are the 9th and the 29th. General discussion. Boise City Police are trying to recruit Ada County deputies offering them more money and retirement and etc. Ada County Sheriff's Department took this to the Ada County Commissioners who responded that they didn't need to increase wages and etc. This caused quite a controversy and the Ada County Commissioners did find some money for wages and etc. This will affect our contract next year. Route to: Re: CU -05-06 CUP for a Height Exception within the Lofts at Eagle River Dear Nancy and Council Members: I respectfully request that you deny the CUP for a height exception for this project, and for any other project proposed along the Boise River. I attended the Planning and Zoning Commission meeting regarding this application. Mark Butler presented a picture of the Hilton Garden Hotel with the trees in the background. In the presented picture, very few of the trees were visible and then only the very tip could be seen. I'll bet anything that this picture will NOT be shown to the members of the city council. The Hilton Garden Hotel is not as high as what is being proposed in this application and the hotel hides many of the trees along the river. I believe that if the height exception is granted, this project will totally obliterate the view of the tree line along the river. The view of the Boise River tree line should be preserved along both sides of both channels. The tree lines are "signature" elements of Eagle's landscape. While a height exception might make sense in the downtown business district, it would be detrimental to allow it along the Boise River. Even the two buildings in North Channel Center seem to overpower the thin tree line; and if I remember correctly, only the top decorative pieces are above 35 feet. In this particular project, the height exception would benefit only the developer. The height exception does not justify the CUP requirements as put forth in Eagle Code. Some suggestions: 1. Consider including Joe Hinson of Northwest Natural Resources Group, he has been working on our BLM land exchange understand that process very well. In talking with BLM it is not a given that all of the BLM parcels in the area will be open space. 2. Ask Mike Truden from BLM to site on the committee. This could help with the regional park and other BLM issues. 3. Include developer representatives on the open space and habitat committee. Given the direction towards more dedication of open space than is required under current code; when combined with community open space will most likely be 30% to 50% on average, you need the land owners buy in. 4. If you are not already planning to do so that one of the directives of the Habitat and Open Space committee is to study the maintenance requirements, fire issues, restoration and/or revegatation, trail standards, fencing, regional versus community open space. 5. Establish a committee of land owners and developers that review the information and recommendations as the process moves along, and you get the buy in from this group. Typically what we see happen in these large multi owner comprehensive plan process is that these plans are developed by people who are not stakeholders and then the plans once put to the test by the developer and/or landowner does not work for various reasons, primarily the costs associated with the development of such a plan is not incorporated into the thought process be it land costs, infrastructure, density or mix of uses. Especially given the extent to which the community and the city want to establish an open space plan and clustered development in this area, you need our buy in along the way not at the end. 6. Establish sub areas. How is this going to work in this process? It is going to be counter productive to have ourselves and SunCor working towards final comprehensive plans under our applications and then have others planning the same area. I would suggest that you have these committees react to our sub area plans and proposals not create competing proposals. Residences and businesses located in the District's service area discharge wastewater into the ESD collection system, a series of interconnected pipes that convey wastewater to ESD's wastewater treatment plant south of Highway 44 near the north channel of the Boise River. At the ESD treatment plant, the wastewater undergoes partial treatment in a set of lagoons, and is then pumped to the City of Boise's West Boise Wastewater Treatment Facility where it undergoes further treatment before being discharged to the Boise River. Does the City of Boise Charge ESD for treating its wastewater? Yes. The City of Boise charges both a capacity fee and monthly operation and maintenance fees. If the District constructs its own wastewater treatment plant (WWTP), ESD would not need to purchase additional capacity from the City of Boise and the monthly operation and maintenance fees would be significantly reduced. Since the agreement began with the City of Boise in 1998, ESD has paid more than $6,000,000 to Boise. What constitutes the ESD service area? The ESD service area generally coincides with the City of Eagle's impact area. How is the District governed and is the City of Eagle involved? The Eagle Sewer District is governed by an independent Board of Directors who are elected by qualified voters who reside within the District's boundaries. The District enjoys a close and productive working relationship with the City of Eagle, but in all respects the District is an independent governmental entity. How was the Eagle Sewer District created? The Eagle Sewer District receives its operating authority from Idaho State Code, Chapter 32, Sections 43-3201 through 42-3238. The Eagle Sewer District was formed in 1963 in response to a need for central sewer service. The City of Eagle was incorporated in 1971. As noted earlier, an elected Board of Directors governs the District. The Board meets on the second Monday of each month at 6:30 p.m. in the office of Eagle Sewer District. The District has retained the engineering firm MWH to prepare a Facility Plan that addresses the capital improvements that are needed for the ESD during the next 20 years. Some of the issues that are being addressed in the Facility Plan include 1) whether to continue with the current operating practice involving partial treatment by ESD followed by further treatment and disposal at the West Boise Wastewater Treatment Facility, 2) evaluating the expected useful life of ESD's existing wastewater treatment plant, 3) evaluating various wastewater treatment alternatives that will be needed to handle more stringent regulatory requirements as well as continued growth in the ESD service area, and 4) examining possible ways to conserve and protect our precious water resources through treatment and reuse. Will ESD patrons be asked to pay more for sewer services in the future? It is likely that monthly sewer bills will increase in the coming years, although the actual amount has yet to be determined. Rate increases will be needed to offset inflation of operational and repair costs, as well as to cover capital costs for building additional treatment facilities that will likely be required in response to more stringent regulatory requirements aimed at enhancements in water quality. Some of the operation and maintenance costs of a potential new WWTP will be offset by reductions in the current fees paid to the City of Boise for treatment. What is meant by the terms wastewater or sewer? The terms "sewer," "sewage," or "wastewater" refers to all the used water and water-bome waste that is generated in homes or business. This includes, but is not necessarily limited to, wastewater from toilets, tubs/showers, sinks, washing machines, garbage disposals and dishwashers. This wastewater is carried from your home or business to the wastewater treatment plant where it is treated, disinfected, and discharged into the Boise River. How much is the sewer service fee? A residential unit pays a flat fee of $26 per month. Commercial accounts can pay much more depending upon the size and type of business. Why is there an Eagle Sewer District levy on my property tax bill? Eagle Sewer District operates almost exclusively on user fees. The small amount you see levied on your property tax bill is applied to the District's property and administrative liability insurance. This funding option is available to all taxing districts. Eagle Sewer District keeps this option open to protect against large spikes in insurance premiums -a lesson learned from the past.
