Ordinance - 2006 - 560 - Amend Title 7/Appoint Plumbing Inspector - 10/10/2006 ORDINANCE NO. 560 AN ORDINANCE OF THE CITY OF EAGLE, IDAHO, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AMENDING TITLE 7, CHAPTER IF, SECTIONS I AND 2 AND ADDING A NEW SECTION 3, OF THE EAGLE CITY CODE; PROVIDING FOR SEVERABILITY; AND, PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Eagle is a municipal corporation organized and operating under the laws of the State of Idaho; and; WHEREAS, the City of Eagle is authorized to appoint officials as deemed necessary for the efficient operation of the City pursuant to Idaho Code S50-204; WHEREAS, by Title 7, Chapter IF, of the Eagle City Code, the City has adopted plumbing standards and provided for plumbing inspection for the protection of public health, safety and welfare; and WHEREAS, the City desires to amend Title 7, Chapter IF, of the Eagle City Code to provide for the appointment of a City plumbing inspector; and WHEREAS, the City desires to further amend Title 7, Chapter IF, of the Eagle City Code to provide for reference to a plumbing fee schedule established by resolution of the Eagle City Council; and NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF EAGLE, Ada County, Idaho; Section I: Eagle City Code Title 7, Chapter I F, Sections I and 2 be and the same hereby are, amended with the underlined text being added and the strikeout text being deleted to read as follows: 7-1F-l: UNIFORM PLUMBING CODE ADOPTED: Except where a different standard is required by this article, +there is hereby adopted by the city for the purpose of prescribing regulations governing minimum standards and requirements for the use of and the design, construction, installation, improvement, extension and alteration of materials, piping, venting, fixtures, appliances and appurtenances in relation to plumbing systems as defined by the uniform plumbing code, and to provide that all plumbing and plumbing systems shall be designed, constructed, installed, improved, extended and altered in substantial accord with the uniform plumbing code published by the international association of plumbing and mechanical officials, and it shall be amended, revised, compiled and published from time to time and as such amendments or revisions are adopted by the Idaho plumbing board, and subject to the conditions, and exceptions and fees prevalent in Idaho Code title 54, chapter 26. Duties: It shall be the duty ofthe plumbing inspector to attend to the enforcement of the provisions of this article, as the same shall pertain to the inspection and supervision of plumbing systems. The plumbing inspector shall have the jurisdictional authority to inspect, and shall inspect, installations of plumbing and related equipment within the city's limits, to give notice of plumbing violations, to issue or cancel plumbing permits, and to otherwise carry out its duties as plumbing inspector for the city. The IdaHO state divisioR efbl:lilding safety plumbing inspector appointed by the city council shall inspect such work and report violations to the building official. C. Compensation: The compensation that the plumbing inspector shall receive for providing services shall be fixed by the Grade and Range Table adopted by the city council ana shall be paid in the same mardler as otHer claims against the oity. (Ord. 363, 2 22 2000) Section 2: Eagle City Code Title 7, Chapter IF, be and the same hereby is, amended to add a new Section 3 with the underlined text being added to read as follows: 7-1F-3: FEE SCHEDULE All buildings shall be subiect to plumbing fees as established and set by resolution of the Eagle city council. A schedule of said fees shall be maintained on file in the office of the citv clerk. Section 3: If any provision or section of this Ordinance shall be held to be invalid by a court of competent jurisdiction, then such provision or section shall be considered separately and apart from the remaining provisions or sections of this Ordinance, which shall remain in full force and effect. Section 4: This Ordinance, or a summary thereof in compliance with Section 50-90IA, Idaho Code, shall be published once in the official newspaper of the City, and shall take effect immediately upon its passage, approval, and publication.
