CALL TO ORDER: Mayor Merrill calls the meeting to order at 5:45 p.m. 2. ROLL CALL: BASTIAN, GUERBER, NORDSTROM, BANDY. All present. A quorum is present. PRE-COUNCIL AGENDA: 5:30 p.m. - 7:30 p.m. I. Foothills Discussion. City Planner Baird Spencer provides Council an overview of the visioning process of the Foothills. Discussion on to move forward and applications that coming to the City. Discussion on the areas of slope in the foothills. Discussion on how to measure acreage when you have hills and slopes. General discussion. Planner Baird Spencer: Further discussion on the foothills and regional open spaces. General discussion. Bill Brownley, M3's representative, this is a very complex area. Discussion on the density in the foothills and the types of development that can be on the slopes. We would be willing to bring our land planner in for discussions. It is necessary to have flexibility in development in the foothills. General discussion. 2. Gibbons Scott and Dean LLP: Jo Bolen will review the fiscal year audit for 2004/2005. Jo Bolen provides an overview of the fiscal year audit for 2004/20005. Discussion on the Management Letter. Discussion on the conversion to Caselle which caused some ending and beginning balance problems. We should have no problems going into 2006. The one area that we did have a problem was the Library turning over the statements and invoices with their payment request. Discussion on the Water Fund, 2005 was the year that the City started receiving the revenue. It is important to stick to the rules of an enterprise fund where all of the expenses for the water fund need to be paid out of the water fund. General discussion. 3. PUBLIC COMMENT: Rose Grandmason, I have been a resident of Eagle for 35 years. I want to discuss the park on Hill Road and how the amenities were decided on. The sidewalk meanders and seems to go now where. It is my understanding that this sidewalk costs $70,000 and it is going to be torn up when Hill Road is developed. General discussion. Jason Pierce, member of the Eagle Economic Development Committee with the Chamber of Commerce, distributes fliers to the Council entitled "Eagle Downtown Visionary Planning" and discusses the same. We have meetings scheduled for October 19th and 25th. We are meeting every week on Tuesdays mornings. General discussion. 5. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Mayor, a Councilmember, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the City Council. . Any item on the Consent Agenda which contains written Conditions of Approval from the City of Eagle City Staff, Planning & Zoning Commission, or Design Review Board shall be adopted as part of the City Council's Consent Agenda approval motion unless specifically stated otherwise. Zoning Administrator Vaughan and City Planner Williams, displays overheads and provides the Council an overview ofthe Development Agreement. General discussion on changes to the Development Agreement. Walter Lindgren, representing the applicants, I have been in close communication with staff. Displays overheads of the Hybrid Alley and discusses the same. General discussion. Core Christenson: Discusses the width of the lots, landscaping and utilities. We did remove 5 lots. The average width of the lots is 55' or larger. We did take a lot of consideration to street widths. Walter Lindgren, discusses the set backs and landscaping. General discussion. Discussion on the amenities, tot lots, community club house and common area. Discussion on the ponds and lakes. General discussion. General discussion parking cars in the driveways and the impact and the parking in the rear of the commercial buildings. Applicant displays an overhead and discusses the downtown core buildings. The garages on the back alley have been eliminated and there is now underneath parking in the commercial area. Chad Longson, discusses the parking of cars in the back roads and alley ways. Walter Lindgren, discusses the parking cars in the residential area. Discussion on the condominium parking. Council directs staff to provide them information on the Two Rivers set backs. Discussion on the lot placements. General discussion on the over all plan. Bandy moves to approve Item #MU-DA (Mixed Use with a development agreement) Lonesome Dove-Hawkins Companies with the following changes to the Development Agreement: #3.12, 3rd line between the word property and adjacent add "on the levy", so that sentence will read: "Applicant shall provide and construct in accordance with the provisions of Eagle City Code, Section 9-4-1-6, a minimum 10' wide asphalt public pathway along the portion of the property on the levy adjacent to the Boise River, and also in Item #3.18, language to the 1st sentence talking about the craftsman's style to add "single family dwellings shall be constructed utilizing Page 3 of 7 K\COUNCll\MINUTES\Temporary Minutes Work Area\CC-09-26-06min.doc craftsman/Americana style" and in the second sentence "commercial/retail buildings, multi-family residential condominiums, single family dwellings and pool house shall be required to meet the Design Review guidelines as set forth in Eagle City Code. Alderwood No.2) Planned Unit Development - RTB Investments, LLC: RTB Investments, LLC, represented by Wendy Kirkpatrick with Landmark Engineering and Planning, is requesting conditional use, preliminary development plan and preliminary plat approvals for Eudora Estates (a.k.a. Alderwood No.2) Planned Unit Development, a 21-lot (16-buildable, 5-common) residential planned unit development. The 4.7-acre site is located approximately 430-feet west of South Grandean Way at 947 West State Street. This item was continued from the September 19, 2006 meeting. (WEV) Mayor introduces the issue. (SJB) Mayor introduces the issue. Guerber moves to pass the Joint Powers Agreement Between the Ada County Sheriff's Office and the City of Eagle Relating to Law Enforcement Services and Prosecution Services and in the Discussion of the Increase of Lieutenant to Captain, I would ask that we revise this to reflect the proposed contract to adjust the salary for the Police Chief and reflect his expanded responsibilities as part of the agreement to over see activities on a limited basis in regards to Star and Kuna. Council concurs to have the City Clerk pursue the City's application and have Mike Moore, City Attorney, review the financing and bring back to the Council. Mavor and Council's Report: Guerber: The Parks and Pathway Committee met last week and they would like to see some standards for pathway widths. Also, discussed a resolution for the creation of a recreation district with a revenue stream for development of parks and pathways. Committee would like to find a revenue stream. The Committee is particularly concerned about the West Eagle area and park planning. General discussion. Nordstrom: No report. Bastian: No meeting with the Library Board. Design Review is doing a great job. Bandy: The Citizens Water Committee meeting is on Thursday. General discussion on the goals for the committee.
