The Board continued the item to the August 24, 2006, and made their decision at that time. The Eagle Design Review Board having heard and taken oral and written testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law; FINDINGS OF FACT: A. PROJECT SUMMARY: Cobblestone Properties, LLC, represented by Russ Philips with Insight Architects, is requesting design review approval of a master sign plan for a multi-tenant medical office and professional office building. The 2.2-acre site is located on the north side of West State Street at the northwest corner of North Story Book Way and West State Street at 450 West State Street. B. COMPREHENSIVE PLAN PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: . Protect and enhance the small town character of the City by requiring signage which is creative and distinctive, compatible with its surroundings, and an integral component of the style and character of the building to which it relates. B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: . Eagle City Code Section 8-2A-2(B) The general theme of the Design Review Overlay District is to specify desirable building and landscape architectural styles and materials to create a sustainable and pleasing environment for residents and visitors alike. The architectural designs, materials, and graphics set forth in this article are complied to create a theme unique to the area called "Eagle Architecture". . Eagle City Code Section 8-2A-6(A)(4) Signage for any project shall provide for business identification and minimize clutter and confusion on and off the site. . Eagle City Code Section 8-2A-6(A)(4)(c) Signs are to provide effective and necessary business identification systems adapted to the building design. . Eagle City Code Section 8-2A-6(A)(4)(e) The size, location, design, color, texture, lighting, landscaping, and hours of operations of all permanent signs and outdoor advertising structures or features to insure that any such proposals do not detract from the function of, or design of, buildings, structures, surrounding properties, neighborhoods, or streets. . Eagle City Code Section 8-2A-8(C)(1) Sign materials and overall appearance shall compliment the building architecture and colors as determined by the Design Review Board. . Eagle City Code Section 8-2A-8(C)(5)(d) A freestanding single tenant building, not in a shopping center, shall be permitted to construct, erect and maintain one monument sign per street that it abuts to identify the business to which it pertains. The exposed surface of any such sign shall not exceed fifty (50) square feet per exposed surface except that the exposed surface of any such sign within forty feet (40') of a building shall not exceed six feet (6') in height and thirty (30) square feet per exposed surface. . Eagle City Code Section 8-2A-8(E) The design review board must find that any illuminated sign permitted under the specific regulations within this chapter is designed such that brightness levels are controlled to assure a soft, subtle effective light in accordance with other city regulations intended to create and maintain the Eagle Architecture theme. Illumination types, styles, and practices not listed herein shall be prohibited unless otherwise deemed by the Design Review Board and City Council to be consistent with the Eagle Architecture theme. Eagle City Code Section S-2A-S(K)(1) No signs shall be erected or maintained in any district as established by the Zoning Ordinance except those signs specifically enumerated in this Chapter. The number and area of signs as outlined in this Chapter are intended to be maximum standards which do not necessarily ensure architectural compatibility. Therefore, in addition to the enumerated standards, consideration shall be given to a sign's relationship to the overall appearance of the subject property as well as the surrounding community. Compatible design, simplicity and sign effectiveness are to be used in establishing guidelines for sign approval. C. DISCUSSION: . The applicant has shown on the north elevation plans, date stamped by the City on July 6, 2006, eight (S) specific sign areas. Each tenant is permitted a 10-square foot maximum halo illuminated building wall sign within the designated areas. The applicant has not determined how many tenants will occupy the building, but anticipates at least eIght (S) tenants. Therefore, up to eight (S) tenants will be allowed to put a building sign on the south elevation within one of the approved sign area. Each tenant will only be allowed one sign. . The applicant has shown on the south elevation plans, date stamped by the City on July 6, 2006, two (2) specific sign areas on east and west sides of the entrance. Each sign area is approximately 200-square feet. The applicant is proposing to allow individual tenant signs to be located within these signage areas. Each tenant would be permitted a 26-square foot maximum halo illuminated building wall sign within the designated area. The proposed sign plan does not indicate how many signs can be located within the two 200-square foot areas and or where the signs will be placed. To be consistent with the signs permitted on the south elevation, staff recommends the applicant place a maximum of four (4) building wall signs, each of 10-square foot maximum, in each of the proposed sign areas. Therefore, a maximum of eight (S) tenants will be allowed to put a sign on the north elevation, four (4) building wall signs within each of the 200-square feet sign areas. Tenants will only be allowed one sign within one of the two approved sign areas. Staff has added these recommendations to the Master Sign Plan Criteria. . The proposed Master Sign Plan criteria states block style letters and individually back lit/halo letters, illuminated by neon or L.E.D. will be the only style of signage allowed. The color of the block style letters and the color of the neon or L.E.D. are not specified in the Master Sign Plan Criteria. For consistency purposes, staff recommends that the Design Review Board consider one color for the block style letters and one color for neon or L.E.D. Staff has added these recommendations to the Master Sign Plan Criteria, the specific colors agreed upon by the applicant and the Board will need to be specific within the Master Sign Plan Critena. . The applicant is proposing one monument sign at the northwest corner of West State Street and North Storybook Way. The proposed monument sign is located within fifteen feet (15') of the building and is ten feet (10') high by twenty two feet eight inches (22' S") wide. Eagle City Code states the exposed surface of any monument sign within forty feet (40') of a building shall not exceed six feet (6') in height and thirty (30) square feet per exposed surface. The applicant should be required to provide a revised elevation plan showing the monument sign not exceeding thirty (30) square feet and the height of the monument sign not exceeding six feet (6'). The revised elevation plan of the monument sign should be reviewed and approved by the Design Review Board prior to the issuance of a sign permit. Continued to the August 24, 2006 Hearing . On August 10,2006, the Board voted 4 to 0 (Stanger, Wright, and Weber absent) to continue the above mentioned application to allow the applicant time to provide a revised elevation plan of the sign and a revised landscape plan. Provide a revised elevation plan showing an architectural ellipse feature that matches the ellipse feature of the proposed building. 2. Provide a revised elevation plan showing the address on the sign. 3. Provide a revised landscape plan indicating the plants around the sign. 4. Provide material and color sample of the sign, including the color of the sign panels. . On August 15,2006, the applicant submitted a revised elevation plan of the monument sign. The revised elevation plan shows a Hat roof line with an architectural ellipse feature similar to the architecture proposed on the building. Two (2) arriscraft columns are located on each side of the sign with a brick base. The applicant proposed matte black tenant panels peg mounted y," off the face of the monument sign with beige letters. The building address is located vertically between the tenant sign areas. The total sign area of the address and tenant sign panels is approximately twenty-nine (29) square feet. . The applicant has also submitted an enlarged landscape plan and site section plan showing the location of the monument sign in relation to the building and street. The plans indicate that the monument sign is located approximately fourteen feet (14') from the future building and is seven- feet six-inches (7' 6") high. The site section plan, date stamped August 15, 2006, shows the monument sign to be located on a one foot (1) grass berm. This elevates the sign seven feet (7') above the centerline of West State Street. Eagle City Code states the height of the sign shall not exceed six feet (6') measured from the centerline of the adjacent roadway or top of curb. The applicant should be required to provide a revised landscape plan and revised site section plan eliminating the one foot (\ ') grass earth berm that the monument is placed on. The revised landscape plan should show shrubs and or boulders around the base of the sign. The revised enlarged landscape plan and revised site section plan shall be reviewed and approved by staff and two members of the Design Review Board pnor to the issuance of a sign permit. . Staff recommends the following changes for the 450 W. State Street Master Sign Plan criteria: Master Sien Plan Criteria for 450 West State Street Master Sign Plan A. GENERAL APPROVAL REQUIREMENTS: 1. Each tenant shall be required to submit signage plans to the building's managing entity for written approval. A design review sign application. accompanied by the written approval of the managing entity shall be submitted to the City for any proposed signs for City staff review and approval. All signs shall be in compliance with the criteria stated herein as well as Eagle City Code. In cases of any conHict between Eagle City Code and the criteria specified herein, the more restrictive requirements shall apply. STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT: Based upon the information provided to staff to date, staff recommends approval with the site specific conditions of approval and the standard conditions of approval provided within the staff report . PUBLIC MEETING OF THE BOARD: A. A meeting was held on the application before the Design Review Board on August 10, 2006. The item was continued to the August 24, 2006, at which time the Board made their decision. B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one. C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not including the applicant/representative). BOARD DECISION: The Board voted 5 to 0 (Stanger and Barnes absent) to approve DR-76-06 for a design review application for a master sign plan for a multi-tenant medical office and professional office building for Cobblestone Properties, with the following staff recommended site specific conditions of approval and standard conditions of approval with text shown with underline to be added by the Board. SITE SPECIFIC CONDITIONS OF APPROVAL: I. The following document titled "Master Sign Plan Criteria for 450 West State Street" shall be the master sign plan criteria for the 450 W. Each display panel shall be peg mounted 'I," off the face of the monument sign and painted a matte black color. 5. Tenant sign letters shall not exceed 6" in height and shall be a matte beige color. 6. The monument sign shall be illuminated with two (2) ground mounted high pressure sodium light fixtures using 1 OO-watt bulbs per side. 2. Provide a revised landscape plan and revised site section plan eliminating the one foot (\ ') grass earth berm that the monument is placed on. The new landscape plan shall show shrubs and/or boulders around the base of the sign. The revised landscape plan and revised site section plan shall be reviewed and approved by staff and two members of the Design Review Board prior to the issuance of a sign permit. 3. The floodlights used to illuminate the monument sign shall be screened or located so they do not shine onto the roadway or onto any nearby property. The light fixtures shall be concealed or screened with perimeter landscaping providing a 12 month screen of sufficient height and density to conceal such fixtures. 4. A sign permit is required for all proposed signs within the multi-tenant medical and office building prior to a sign being constructed on this site. 5. Provide a revised elevation plan of the monument slim showmg a new letter style for the street numbers using a more readable font stvle. The revised monument elevation plan shall be reviewed and approved by staff and one member of the Design Review Board prior to the issuance of a sign permit. 6. The monument sign along West State Street shall be in the location shown on the enlarged site plan (sheet A5) date stamped by the City of Eagle on August 24,2006. 7. The two address only monument signs along North StOry Book Way and Cobblestone Lane shall be in the locations shown on the enlarged site plans (sheets A3 and A4) date stamped bv the Citv of Eagle on August 24. 2006. An approval letter from Ada County Highway District approving the location of each monument sign shall be submitted prior to the issuance of a sign permit. If Ada County Highway District does not approve the proposed locations, the two (2) signs shall be eliminated. STANDARD CONDITIONS OF APPROVAL: 1. A building permit/zoning permit shall be required prior to construction of any sign which is not attached to a building with an active building permit. 2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review, as stipulated in Eagle City Code (one year from the Design Review Board approval date). 3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with. All design and construction shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the Commission and/or Council. 4. New plans which incorporate any required changes shall be submItted for staff approval. Staff may elect to take those plans to the Design Review Board and/or the Planning and Zoning Commission for review and approval. 5. Any changes to the plans and specifications upon which this approval is based, other than those required by the above conditions, will require submittal of an application for modification and approval of that application prior to commencing any change. 6. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory Page 10 of 11 K:\Planning Depl\Eagle Applications\Dr\2006\DR-76-06 mstr sign plan drfdoc and legal restrictions in force at the time the applicant or its successors in interest advises the City of Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 7. Any modification of the approved design revIew plans must be approved prior to construction/installation of such changes. Failure to do so may result in the requirement to modifY the project to comply with the approved design review and/or result in the inability to issue a certificate of completion for this project. CONCLUSIONS OF LAW: I. The application for this item was received by the City of Eagle on July 6,2006. 2. The Board reviewed the particular facts and circumstances of this proposed design review application (DR-76-06) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review Overlay District, and based upon the information provided with the conditions required herein, concludes that the proposed design review application is in accordance with the Eagle City Code and the Eagle Comprehensive Plan.
