The above-entitled design review application came before the Eagle Design Review Board for their action
on July 13, 2006. The Eagle Design Review Board having heard and taken oral and written testimony, and
having duly considered the matter, makes the following Findings of Fact and Conclusions of Law;
FINDINGS OF FACT:
A. PROJECT SUMMARY:
Robert Erland, represented by James Gipson with James Gipson Associates, is requesting design
review approval of a master sign plan for two multi-tenant office buildings within Inland
Subdivision. The 1.64-acre site is located on the south side of East Iron Eagle Drive
approximately ISO-feet east of South Fitness Place at 1371 and 1395 East Iron Eagle Drive.
B. APPLICATION SUBMITTAL:
The City of Eagle received the application for this item on May 4, 2006.

STAFF ANALYSIS:
A. COMPREHENSIVE PLAN PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING
THIS PROPOSAL:
. Protect and enhance the small town character of the City by requiring signage which is creative
and distinctive, compatible with its surroundings, and an integral component of the style and
character of the building to which it relates.
B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS
PROPOSAL:
. Eagle City Code Section 8-2A-2(B)
The general theme of the Design Review Overlay District is to specify desirable building and
landscape architectural styles and materials to create a sustainable and pleasing environment
for residents and visitors alike. The architectural designs, materials, and graphics set forth in
this article are complied to create a theme unique to the area called" Eagle Architecture".

Signage for any project shall provide for business identification and minimize clutter and
confusion on and off the site.

Signs are to provide effective and necessary business identification systems adapted to the
building design.

The size, location, design, color, texture, lighting, landscaping, and hours of operations of all
permanent signs and outdoor advertising structures or features to insure that any such
proposals do not detract from the function of, or design of, buildings, structures, surrounding
properties, neighborhoods, or streets.

Sign materials and overall appearance shall compliment the building architecture and colors as
determined by the Design Review Board.

b. Any business within a multi-tenant building that is located on a street comer or which fronts
two (2) streets shall be allowed two (2) wall signs. The sides of the building on which the
signs are to be placed shall be shown by the owner, but shall be as approved by the design
review board.
. Eagle City Code Section 8-2A-8(C)(5)(d)
d. A freestanding single tenant building, not in a shopping center, shall be permitted to
construct, erect and maintain one monument sign per street that it abuts to identify the
business to which it pertains. The exposed surface of any such sign shall not exceed fifty (50)
square feet per exposed surface except that the exposed surface of any such sign within forty
feet (40') of a building shall not exceed six feet (6') in height and thirty (30) square feet per
exposed surface

No signs shall be erected or maintained in any district as established by the Zoning Ordinance

except those signs specifically enumerated in this Chapter. The number and area of signs as
outlined in this Chapter are intended to be maximum standards which do not necessarily
ensure architectural compatibility. Therefore, in addition to the enumerated standards,
consideration shall be given to a sign's relationship to the overall appearance of the subject
property as well as the surrounding community. Compatible design, simplicity and sign
effectiveness are to be used in establishing guidelines for sign approval.
C. DISCUSSION:
. The applicant has shown on the Master Sign Plan Elevations Building A and Building B (date
stamped by the City on May 4, 2006), the specific areas for tenant signage upon the multi-tenant
office buildings. Each individual tenant is required to place their business identification words or
phrases and logo within the approved sign area as permitted within the Master Sign Plan Criteria
for Erland Iron Eagle Buildings. Eagle City Code allows business within a multi-tenant building
that fronts two (2) streets walls signs on two sides of the building. Building A indicates walls
signs on three sides of the building; therefore staff has incorporated a condition stating signs
should be permitted only on the north and south elevations.
. The design and materials for the monument sign along East Iron Eagle Drive are shown on the
Monument Signs Elevation date stamped by the City on May 4, 2006. The size and height
restrictions are in compliance with the Eagle City Code. The applicant has decided that the
monument sign will be shared/used by all the tenants within the two proposed office buildings and
the future building. Landscaping comprising three times the sign single face area is provided in
compliance with the sign ordinance. One recessed light, screened by landscaping, is proposed on
each side of the monument sign for illumination.
. Staffrecommends the following changes to the applicant's document titled "Master Sign Plan for
Erland Iron Eagle Buildings". Master Sign Plan Criteria with strike thru text to be deleted and
underlined text to be added so as to be in compliance with the City of Eagle Code.
Master Sign Plan Criteria
for Inland Subdivision
I. Each tenant or occupant shall be required to submit signage plans to the building's managing
entity for written approval. A Design Review application, accompanied by the written
approval of the managing entity, shall be submitted to the City of Eagle for any proposed
tenant signs for City staff review and approval. All signs shall be in compliance with the
criteria stated herein as well as Eagle City Code. In cases of any conflict between Eagle City
Code and the criteria specified herein, the more restrictive shall apply.
2. Building wall signs shall be placed within the approved sign areas as designated on the sign
building elevations. Tenant signs shall be located within the designated areas shown on the
attached elevation plans of Building A and B.
3. Tenant signs on the north and south elevations of Building A shall not exceed thirty (30)
square feet). No signs are permitted on the east and west elevations of Building A.
4. Tenant signs on the north and south elevations of Building B shall not exceed fourteen (14)
square feet for spaces A and C and twelve and one-half (12.5) square feet for space B. No
signs are permitted on the east and west elevations of Building B.
5. SigH area within the gable areas shall not ellseea fifteen (15) square feet. If multiple tenant
entry doors are located within the same gable entry as shown on Building A. each tenant shall
be allocated to use fifteen (15) square feet for their sign. tenant's shall be allowed the total

6. Letters shall be non-illuminated.
7. Letters shall be flat or matte black, or other approved earth tone colors. No glossy paints,
vinyl, or plexi-glass is permitted.
8. All letters and logos within the building walls signs shall be constructed of a hi-density
urethane material Y2" (minimum) thick or the face of the wood signs shall have dimension by
routing or extrusion, with a minimum Yo" relief.
9. Letters on the tenant panels provided on the monument sign shall be "block" font three and
one-half inches (31/2") high. The maximum logo size permitted shall be 6" x 8". All letters
and logos shall be black.
10. All sign elements shall be painted with an historic color palate. If the City of Eagle staff
determines that a proposed color differs significantly from the colors depicted on the colored
rendering submitted to the City for the monument sign or the building itself wall signs, the
City staff may elect to have the City Design Review Board and/or City Council review the
color for appropriateness.
11. Onlv one monument sign, located along East Iron Eagle Drive, shall be permitted on the site.
It shall be used/shared bv all the tenants within the two existing buildings and future building.
12. Exterior illumination for the monument sign shall be ground mounted or recessed and shall be
shielded with landscape materials maintaining a year-round effective screen. One fixture,
using a 100-watt incandescent of high pressure sodium light source, shall be allowed on each
side of the monument sign.
13. All wall-mounted signs will be illuminated with fixtures placed in the soffit above the signs,

14. The wall-mounted sign will be illuminated witfl ill' an existing 75-watt recessed light in the
sofit above.
15. No electrical conduits or raceways are permitted.
16. Any other or temporary signage such as grand opening, etc. shall comply with Eagle City
Code.
17. Any signage on or in doors and windows shall comply with Eagle City Code.
18. Upon termination of their lease, the tenant or managing entity shall neatly seal all penetrations
of the building wall mounted structure in a watertight condition that matches the texture, color,
and material used in the construction of the building and refinished to match the pre-existing
condition of the building surface.
. Staff defers comment regarding design and color of all proposed signs to the Design Review
Board.
STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT:
Based upon the information provided to staff to date, staff recommends approval with the site
specific conditions of approval and the standard conditions of approval provided within the staff
report.

PUBLIC MEETING OF THE BOARD:
A. A meeting was held on the application before the Design Review Board on July 13, 2006, at which
time the Board made their decision.
B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one.
C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not
including the applicant/representative).
BOARD DECISION:
The Board voted 5 to 0 (Barnes and Wright absent) to approve DR-48-06 for a design review
application for a master sign plan for two multi-tenant office buildings within Inland Subdivision
for Robert Erland, with the following staff recommended site specific conditions of approval and
standard conditions of approval with text shown with underline to be added by the Board.
SITE SPECIFIC CONDITIONS OF APPROVAL:
1. The following document titled "Master Sign Plan Criteria for Erland Iron Eagle Buildings." shall be
the master sign plan criteria for the buildings located at 1371 and 1395 East Iron Eagle Drive.

building wall sign locations. The Master Sign Plan for the future pad site should compliment this
Master Sign Plan.
4. The tenants within the future building on the north side of the site shall share/use the monument sign,
including the sign design and color criteria, approved with this application (DR-48-06).
5. A sign permit is required for all proposed signs within the buildings located at 1371 and 1395 East
Iron Eagle Drive prior to a sign being constructed on this site.
6. Provide a revised elevation of the monument sign showing the roof style, pitch and eaves, to match the
proposed buildings. The revised elevation of the monument sign shall be reviewed and approved bv
staff prior to the City issuing a sign permit for this site.
7. Provide a revised elevation of the monument sign showing colors matching the proposed colors of
Building B. The revised elevation of the monument sign shall be reviewed and approved bv staff prior
to the City issuing a sign permit for this site.
STANDARD CONDITIONS OF APPROVAL:
1. A building permit/zoning permit shall be required prior to construction of any sign which is not
attached to a building with an active building permit.
2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review,
as stipulated in Eagle City Code (one year from the Design Review Board approval date).
3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable
County, State and Federal Codes and Regulations shall be complied with. All design and construction
shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the
Commission and/or Council.

4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may
elect to take those plans to the Design Review Board and/or the Planning and Zoning Commission for
review and approval.
5. Any changes to the plans and specifications upon which this approval is based, other than those
required by the above conditions, will require submittal of an application for modification and
approval of that application prior to commencing any change.
6. Any change by the applicant in the planned use of the property which is the subject of this application,
shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory
and legal restrictions in force at the time the applicant or its successors in interest advises the City of
Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said
requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is
sought.
7. Any modification of the approved design review plans must be approved prior to
construction/installation of such changes. Failure to do so may result in the requirement to modifY the
project to comply with the approved design review and/or result in the inability to issue a certificate of
completion for this project.
CONCLUSIONS OF LAW:
I. The application for this item was received by the City of Eagle on May 4, 2006.
2. The Board reviewed the particular facts and circumstances of this proposed design review application
(DR-48-06) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review
Overlay District, and based upon the information provided with the conditions required herein,
concludes that the proposed design review application is in accordance with the Eagle City Code and
the Eagle Comprehensive Plan.
