EVAN HATHAWAY ) FINDINGS OF FACT AND CONCLUSIONS OF LAW CASE NUMBER DR-46-06 The above-entitled design review application came before the Eagle Design Review Board for their action on June 8, 2006. The Eagle Design Review Board having heard and taken oral and written testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law; FINDINGS OF FACT: A. PROJECT SUMMARY: Dr. Evan Hathaway, represented by Neil Caldwell with Idaho Electric Signs, is requesting design review approval of two building wall signs and one monument sign for Evan Hathaway DDS, PA. The site is located on the south side of East Iron Eagle Drive within Rocky Mountain Business Park No.3 on Lot 8, Block 1. B. APPLICATION SUBMITTAL: The City of Eagle received the application for this item on May 4,2006. C. HISTORY OF RELEVANT PREVIOUS ACTIONS: On February 21, 2006, the Eagle City Council approved a design review sign application for two building wall signs for Evan Hathaway DDS (DR-lOS-OS). D. AGENCY RESPONSES: None I. LETTERS FROM THE PUBLIC: None received to date STAFF ANALYSIS PROVIDED WITHIN THE STAFF REPORT: A. COMPREHENSIVE PLAN PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: Chapter 12 - Community Design 12.3 Entry Corridors Entryway corridors are arterial roadways that introduce both visitors and residents to Eagle City entryways include State Highways 44 (State Street and Alternate Route) and 55 (Eagle Road). The City of Eagle has the responsibility to guide development and redevelopment that occurs along these entryway corridors. Design review procedures should guide future development and redevelopment of existing uses. Depending on land uses and buildings, more extensive landscaping and fewer points of access may be required. The design review process will afford the opportunity to address the special features of each property and facility in a manner that will best address the overall intent of enhancing Eagle's entryways. Eagle's entrance corridors may take on the look of berms built adjacent to the Banbury and Lexington Hill Subdivisions. 12.4 Implementation Strategies p. Protect and enhance the small town character of the City by requiring signage which is creative and distinctive, compatible with its surroundings, and an integral component of the style and character of the building to which it relates. B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: . Eagle City Code Section 8-2A-2(B) The general theme of the Design Review Overlay District is to specify desirable building and landscape architectural styles and materials to create a sustainable and pleasing environment for residents and visitors alike. The architectural designs, materials, and graphics set forth in this article are complied to create a theme unique to the area called "Eagle Architecture". . Eagle City Code Section 8-2A-6(A)(4) Signage for any project shall provide for business identification and minimize clutter and confusion on and off the site. . Eagle City Code Section 8-2A-6(A)(4)(c) Signs are to provide effective and necessary business identification systems adapted to the building design. . Eagle City Code Section 8-2A-6(A)(4)(e) The size, location, design, color, texture, lighting, landscaping, and hours of operations of all permanent signs and outdoor advertising structures or features to insure that any such proposals do not detract from the function of, or design of, buildings, structures, surrounding properties, neighborhoods, or streets. . Eagle City Code Section 8-2A-8(C)(l) Sign materials and overall appearance shall compliment the building architecture and colors as determined by the Design Review Board. . Eagle City Code Section 8-2A-8(C)(4)(a) A freestanding single tenant building shall be allowed two (2) wall signs, provided that, each sign is placed on a different side of the building. The entire building shall be permitted one monument sign for every street it fronts. The sides of the building on which the signs are to be placed shall be shown by the owner, but shall be as approved by the design review board. . Eagle City Code Section 8-2A-8(C)(d)(d) A freestanding single tenant building, not in a shopping center, shall be permitted to construct, erect and maintain one monument sign per street that it abuts to identify the business to which Page 3 of 6 K:\Plalllling Dept\Eagle Applicatiolls\Dr\2006\DR-46-06 sign Jrf,doc it pertains. The exposed surface of any such sign shall not exceed fifty (50) square feet per exposed surface except that the exposed surface of any such sign within forty feet (40') of a building shall not exceed six feet (6') in height and thirty (30) square feet per exposed surface. . Eagle City Code Section 8-2A-8(E) The design review board must find that any illuminated sign permitted under the specific regulations within this chapter is designed such that brightness levels are controlled to assure a soft, subtle effective light in accordance with other city regulations intended to create and maintain the Eagle Architecture theme. Illumination types, styles, and practices not listed herein shall be prohibited unless otherwise deemed by the Design Review Board and City Council to be consistent with the Eagle Architecture theme. . Eagle City Code Section 8-2A-8(K)(l) No signs shall be erected or maintained in any district as established by the Zoning Ordinance except those signs specifically enumerated in this Chapter. The number and area of signs as outlined in this Chapter are intended to be maximum standards which do not necessarily ensure architectural compatibility. Therefore, in addition to the enumerated standards, consideration shall be given to a sign's relationship to the overall appearance of the subject property as well as the surrounding community. Compatible design, simplicity and sign effectiveness are to be used in establishing guidelines for sign approval. . Eagle City Code Section 8-2A-8(M)(16) Door signs identifying the business and/or indicating business hours, emergency phone numbers, etc., shall be permitted up to a maximum of two (2) square feet. C. DISCUSSION: . With this application, the applicant has requested approval of a monument sign. The building is located along the State Highway 44 which is an entry corridor that introduces both visitors and residents to Eagle. It is Eagle's goal to leave everyone with a favorable impression of the community as one drives through this corridor, as this area defines the design standards for the rest of the city. Therefore, site building, and landscape design is reviewed carefully through this corridor to help enhance Eagle's image. Signage is also one of the development features that is carefully reviewed. It is recognized that signage shall provide for business identification, but needs to minimize clutter and confusion on and off the site. Although monument signs are, in part, allowed by code, it is the City's intention to minimize the number of monument signs along State Highway 44 which greatly helps reduce the amount of clutter along the street. There are a couple large shopping centers along State Highway 44 that have multi-tenant monument signs for the entire center and one large mixed-use project that has the option to install some multi-tenant monument signs in the future. A majority of the single building or multi-tenant building projects within the entryway corridor have Master Sign Plans that prohibit monument signs. There are six buildings within the Rocky Mountain Business Center, including the subject site, which front State Highway 44. Three of these buildings already have an approved Master Sign Plan that prohibits monument signs. It is staff's opinion that a monument sign is not appropriate at this location and a condition has been incorporated recommending that no monument signs are permitted. Staff encourages the Board to review and comment on whether a monument sign is appropriate in this location. . The applicant is proposing two building wall signs, one on the north and one on the south building elevations. The applicant is proposing to construct a non illuminated, dimensional building wall sign on the north elevation and a halo illuminated building wall sign on the south elevation. Although Eagle City Code does not specifically require all signs on a building to constructed the same (i.e.: halo illuminated or non illuminated), the City has required on multi-tenant building all Page 4 of 6 K:\Plulllling Dept\Eagle Applications\Dr\2006\DR~46--06 sign drf,doc signs be halo illuminated, non illuminated, dimensional, etc. The applicant should be required to provide revised elevation plans showing the building wall signs proposed on the north and south building elevations to be halo illuminated or non illuminated but not both. The revised elevation plans should be reviewed and approved by the Design Review Board prior to the City issuing a sign permit for this site. . Staff defers comment regarding design and color of all proposed signs to the Design Review Board. STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT: Based upon the information provided to staff to date, staff recommends approval with the site specific conditions of approval and the standard conditions of approval provided within the staff report. PUBLIC MEETING OF THE BOARD: A. A meeting was held on the application before the Design Review Board on June 8, 2006, at which time the Board made their decision. B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one. C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not including the applicant/representative). BOARD DECISION: The Board voted 5 to 0 (Grubb absent) to approve DR-46-06 for a design review application for two building wall signs for Dr. Evan Hathaway, with the following staff recommended site specific conditions of approval and standard conditions of approval with text shown with strike thru to be deleted by the Board and text shown with underline to be added by the Board. SITE SPECIFIC CONDITIONS OF APPROVAL: 1. Provide revised elevation plans showing the building wall signs proposed on the north and south building elevations to be halo illuminated or RElR illllmiRatea Bllt Ret B8th. The revised elevation plans shall be reviewed and approved by staff tile DesigR Review HoarE! prior to the City issuing a sign permit for this site. 2. No monument signs are approved with this application. 3. A sign permit is required prior to a sign being constructed on this site. STANDARD CONDITIONS OF APPROVAL: I. A building permit/zoning permit shall be required prior to construction of any sign which is not attached to a building with an active building permit. 2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review, as stipulated in Eagle City Code (one year from the Design Review Board approval date). 3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with. All design and construction shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the Commission and/or Council. 4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may elect to take those plans to the Design Review Board and/or the Planning and Zoning Commission for review and approval. 5. Any changes to the plans and specifications upon which this approval is based, other than those Page 5 of 6 K:\Planning Dept\Eagk: Applicutions\Dr\2006\DR-46-06 Siglll..bf.doc required by the above conditions, will require submittal of an application for modification and approval of that application prior to commencing any change. 6. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the City of Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 7. Any modification of the approved design review plans must be approved prior to construction/installation of such changes. Failure to do so may result in the requirement to modify the project to comply with the approved design review and/or result in the inability to issue a certificate of completion for this project. CONCLUSIONS OF LAW: I. The application for this item was received by the City of Eagle on May 4, 2006. 2. The Board reviewed the particular facts and circumstances of this proposed design review application (DR-46-06) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review Overlay District, and based upon the information provided with the conditions required herein, concludes that the proposed design review application is in accordance with the Eagle City Code and the Eagle Comprehensive Plan. 3. The Board recognizes State Highway 44 as an entry corridor that provides the first, and oftentimes the most lasting impressions of the entire community. As required within the 2000 Comprehensive Plan, the design review process addresses the special features of each property and facility in a manner that will best address the overall intent of enhancing Eagle's entryways. With regard to the site's overall signage, the Board recommends that no monument signs be allowed on State Highway 44 so as to provide a pristine entryway that one will remember because of the creative landscaping free of monument signs. If the City Council determines that a monument sign should be permitted along State Highway 44, the Board recommends, the revised monument and landscape plans be submitted to the Design Review Board for review and approval.
