RESOLUTION NO. 06-28
A RESOLUTION OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, CLARIFYING
THA T THE EMERGENCY DECLARED BY RESOLUTION BY THE CITY OF
EAGLE ON APRIL 6, 2006, IS A LOCAL DISASTER EMERGENCY, PURSUANT
TO TITLE 46, CHAPTER 10 OF THE IDAHO STATE CODE AND ALL OTHER
APPLICABLE PROVISIONS OF IDAHO CODE
WHEREAS, precipitation and snow melt have caused flooding in portions of the City of
Eagle, Idaho (the "City"), additional precipitation and snow melt are anticipated, and the
City continues to be in imminent danger of additional flooding;
WHEREAS, the City declared an emergency on April 6, 2006 with the passage of
Resolution 06-13;
WHEREAS, the City clearly intended that such declared emergency be considered a local
disaster emergency as contemplated by Idaho Code;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF EAGLE, Ada County, Idaho, as follows:
Section 1. That the Resolution of April 6, 2006, declared, and was intended to
declare, an emergency and local disaster emergency, pursuant to Title 46, Chapter 10,
Idaho Code, Title 67, Chapters 23 and 28, Idaho Code, and all other applicable code
sections of the Idaho State Code.
Section 2. Such local disaster emergency shall continue in effect until the emergency
is terminated by resolution of the City.
Section 3. A copy of the April 6, 2006 Resolution, entitled Resolution 06-13, IS
hereby attached and incorporated as Exhibit A.
Section 4. This resolution and any subsequent resolution terminating the local
disaster emergency shall be recorded with the Ada County Recorder as required by law.

A RESOLUTION OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, DECLARING
AN EMERGENCY; CALLING AN EMERGENCY MEETING OF THE CITY
COUNCIL UNDER SECTION 67-2343(2), IDAHO CODE; AUTHORIZING THE
EMERGENCY EXPENDITURE OF PUBLIC FUNDS UNDER SECTION 67-2808(1),
IDAHO CODE; PROVIDING FOR RELATED MATTERS; AND, PROVIDING AN
EFFECTIVE DATE
WHEREAS, precipitation and snow melt have caused flooding in portions of the City of
Eagle, Idaho (the "City"), and additional precipitation and snow melt are anticipated;
WHEREAS, it is necessary for the City to do emergency work to safeguard life, health or
property;
WHEREAS, the City must immediately meet to declare an emergency and authorize
emergency work; and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF EAGLE, Ada County, Idaho, as follows:
Section I. That pursuant to Idaho Code ~67-2343(2), the City may avoid the notice
requirements for special meetings in the event of an emergency; and
Section 2. That pursuant to Idaho Code ~67-2808(l), the City may avoid the bidding
requirements for the expenditure of public funds in the event of an emergency; and
Section 3. That an emergency exists, pursuant to Idaho Code ~~ 67-2343(2) and 67-
2808(1), in that the City must immediately declare an emergency and authorize
emergency work under Idaho Code 967-2808(1); and
Section 4. That pursuant to Idaho Code 967-2343(2) the Mayor and Council do
hereby declare an emergency and call an emergency special meeting for 12:00 p.m. on
April 6, 2006.
Section 5. That pursuant to Idaho Code 967-2808(1), the Mayor and Council do
hereby declare an emergency and authorize the emergency expenditure of public funds to
do emergency work within the City.
