RESOLUTION No. 06-19
A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE UTILITY, DRAINAGE, AND
IRRIGATION EASEMENTS ALONG THE SIDE LOT LINES OF LOTS 2 AND 3, BLOCK I,
(COUNTRYSIDE ESTATES NO. I) AS SHOWN ON THE ATTACHMENTS HERETO; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Stephen and Charlene Ford requested a vacation to the final plat of Countryside
Estates No. I to remove the utility, drainage, and irrigation easements along the side lot lines of Lots 2 and
3, Block I, (Countryside Estates No. I); and
WHEREAS, On August IS, 2005, the Commission passed a motion recommending approval of
the vacation (V AC-02-05), with conditions, to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in the The
Valley Times on October 31, 2005 and November 7, 2005; and
WHEREAS, On September 20, 2005, the City Council held a public hearing on the proposed
vacation (V AC-2-05), and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates utility, drainage, and irrigation easements along the side lot
lines of Lots 2 and 3, Block I, of the final plat of Countryside Estates No. I, as considered, heard and
approved by the Council at its September 20, 2005 public hearing for application number V AC-02-05 and
as shown on the attachments hereto.
This Resolution shall be in full force and effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho, this 25th day of April, 2006.
