Findings - DR - 2009 - DR-73-05 MOD - Modify The Monument Signs For Corrente Bello Subdivision BEFORE THE EAGLE DESIGN REVIEW BOARD IN THE MATTER OF AN APPLICATION ) FOR A DESIGN REVIEW TO MODIFY THE ) MONUMENT SIGNS FOR CORRENTE BELLO ) SUBDIVISION FOR GEMSTAR DEVELOPMENT ) FINDINGS OF FACT AND CONCLUSIONS OF LAW CASE NUMBER DR-73-05 MOD The above-entitled design review application came before the Eagle Design Review Board for their action on April 13, 2006. The Eagle Design Review Board having heard and taken oral and written testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law; FINDINGS OF FACT: A. PROJECT SUMMARY: Gemstar Development, represented by Matt Adams with The Land Group, Inc., is requesting design review approval to modify the monument signs for Corrente Bello Subdivision. The site is located on the north side of Floating Feather Road approximately V2-mile west of Eagle Road. B. APPLICATION SUBMITTAL: The City of Eagle received the application for this item on March 9, 2006. C. HISTORY OF RELEVANT PREVIOUS ACTIONS: On August 9, 2005, the Eagle City Council approved a conditional use, preliminary development plan, and preliminary plat application for Corrente Bello Subdivision (RZ-7-05/CU-3-05/PPUD-2- 05/PP-7 -05). On November 9, 2005, the Eagle City Council approved a design review for four monument signs for Corrente Bello Subdivision (DR-73-05). On March 14,2006, the Eagle City Council approved a design review application for an entry structure with signage for Corrente Bello Subdivision (DR-02-06). D. COMPANION APPLICATIONS: None E. COMPREHENSIVE PLAN PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: (None) B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: . Eagle City Code Section 8-2A-8(C)(I) Intent: It is the intent of this subsection to encourage interesting, creative and unique approaches to the design of signs. Sign materials and overall appearance shall complement the building architecture and colors as determined by the design review board. Eagle City Code Section 8-2A-8(C)(5)(c) Monument signs located within the entire design review overlay district, excluding monument signs within the DDA, TDA, and "shopping centers" shall not exceed eight feet (8') in height (including the solid base) measured from the centerline of the adjacent roadway or top of curb, if one exists. . Eagle City Code Section 8-2A-8(C)(5)(f) Subdivision monument signs shall be a maximum of eight feet (8') high and shall have a maximum surface area of fifty (50) square feet. A sign may be permitted on each side of any entry road into a subdivision and at the intersection of any collector and/or arterial streets abutting the subdivision. Eagle City Code Section 8-2A-6(A)(4) C. DISCUSSION: . On November 9, 2005, the Eagle City Council approved a design review application for four monument signs within Corrente Bello Subdivision (DR-73-05). On March 14, 2006, the Eagle City Council approved a design review application an entry structure with signage within Corrente Bello Subdivision (DR-02-06). The applicant is requesting a modification to DR-73-05, to modify the location and style of three (3) of the four (4) monument signs. The number of monument signs originally approved will not change with this modification. The two (2) monument signs originally approved on Floating Feather Road were to be located on the east or west sides of the entry roads into the subdivision nestled into the berm of the subdivision. The height of these monument signs were approved at eleven feet ten inches (I I' 10"). The applicant is requesting approval to locate the monument signs within the center island of each entrance on Floating Feather Road. The height of the monument signs will not exceed eight feet (8'). The style of the monument signs remain the same but reduced in height and width. A four foot (4') high monument sign was originally approved to be located at the intersection of Moon Bello and Costa Bello. The applicant is requesting approval to construct an eleven foot ten inch (11' 10") high monument structure at the intersection of Costa Bello and Colline Bello. This monument structure is proposed to be nestled into a berm with a trellis structure on each side. . Staff defers comment regarding design and color of all proposed signs to the Design Review Board. STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT: Based upon the information provided to staff to date, staff recommends approval with the site specific conditions of approval and the standard conditions of approval provided within the staff report. PUBLIC MEETING OF THE BOARD: A. A meeting was held on the application before the Design Review Board on April 13, 2006, at which time the Board made their decision. B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one. C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not including the applicant/representative). Page 3 of 5 K:\Plamung Dept\Eagk Applicatiolls\Dr\2005\DR-73-05 MOD sign dtf.doc BOARD DECISION: The Board voted 6 to 0 (MacDonald absent) to approve DR-73-05 MOD for a design review application to modify the monument signs for Corrente Bello Subdivision for Gemstar Development, with the following staff recommended site specific conditions of approval and standard conditions of approval with text shown with underline to be added by the Board. SITE SPECIFIC CONDITIONS OF APPROVAL: 1. The floodlights used to illuminate the monument sign shall be screened or located so they do not shine onto the roadway or onto any nearby property. The light fixtures shall be concealed or screened with perimeter landscaping providing a 12 month screen of sufficient height and density to conceal such fixtures. 2. The applicant shall be required to obtain a building permit prior to the monument structure located at the intersection of Costa Bello and Colline Bello being constructed. 3. A sign permit is required prior to the installation of a sign within this development. 4. Provide a revised elevation plan showing the height of the berm in relationship to the proposed Monument Tvpe "B". The revised elevation plan shall be reviewed and approved bv staff prior to the Citv issuing a sign permit for this site. STANDARD CONDITIONS OF APPROVAL: 1. A building permit/zoning permit shall be required prior to construction of any sign which is not attached to a building with an active building permit. 2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review, as stipulated in Eagle City Code (one year from the Design Review Board approval date). 3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with. All design and construction shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the Commission and/or Council. 4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may elect to take those plans to the Design Review Board and/or the Planning and Zoning Commission for review and approval. 5. Any changes to the plans and specifications upon which this approval is based, other than those required by the above conditions, will require submittal of an application for modification and approval of that application prior to commencing any change. 6. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the City of Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 7. Any modification of the approved design review plans must be approved prior to construction/installation of such changes. Failure to do so may result in the requirement to modify the project to comply with the approved design review and/or result in the inability to issue a certificate of completion for this project. The Board reviewed the particular facts and circumstances of this proposed design review application (DR-73-05 MOD) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review Overlay District, and based upon the information provided with the conditions required herein, concludes that the proposed design review application is in accordance with the Eagle City Code and the Eagle Comprehensive Plan.
