The Eagle Design Review Board having heard and taken oral and written testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law; FINDINGS OF FACT: A. PROJECT SUMMARY: Mountain West Bank, represented by Andrew Erstad with Erstad Architects, is requesting design review approval of a master sign plan for a single-tenant building and a multi-tenant retail building. The site is located on the southwest comer of East Iron Eagle Drive and Edgewood Lane within Merrill Subdivision No.1 (formerly Rocky Mountain Business Park) at 1539 East Iron Eagle Drive. B. APPLICATION SUBMITTAL: The City of Eagle received the application for this item on January 19, 2006. C. HISTORY OF RELEVANT PREVIOUS ACTIONS: On July 27, 2004, the Eagle City Council approved a design review board application for a bank building, restaurant building, and a multi-tenant retail building (DR-38-04). On July 27, 2004, the Eagle City Council approved a design review board application for a the master sign plan for a bank building, restaurant building, and a multi-tenant retail building (DR- 39-04). Protect and enhance the small town character of the City by requiring signage which is creative and distinctive, compatible with its surroundings, and an integral component of the style and character of the building to which it relates. B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: . Eagle City Code Section 8-2A-2(B) The general theme of the Design Review Overlay District is to specifY desirable building and landscape architectural styles and materials to create a sustainable and pleasing environment for residents and visitors alike. The architectural designs, materials, and graphics set forth in this article are complied to create a theme unique to the area called" Eagle Architecture". . Eagle City Code Section 8-2A-6(A)(4) Signage for any project shall provide for business identification and minimize clutter and confusion on and off the site. . Eagle City Code Section 8-2A-6(A)(4)(c) Signs are to provide effective and necessary business identification systems adapted to the building design. . Eagle City Code Section 8-2A-6(A)(4)(e) The size, location, design, color, texture, lighting, landscaping, and hours of operations of all permanent signs and outdoor advertising structures or features to insure that any such proposals do not detract from the function of, or design of, buildings, structures, surrounding properties, neighborhoods, or streets. . Eagle City Code Section 8-2A-8(C)(1) Sign materials and overall appearance shall compliment the building architecture and colors as determined by the Design Review Board. . Eagle City Code Section 8-2A-8(C)(4)(a & b) a. A freestanding single tenant building shall be allowed two (2) wall signs, provided that, each sign is placed on a different side of the building. The entire building shall be permitted one monument sign for every street it fronts. The sides of the building on which the signs are to be placed shall be shown by the owner, but shall be as approved by the design review board. b. Any business within a multi tenant building that is located on a street comer or which fronts two (2) streets shall be allowed two (2) wall signs. The sides of the building on which the signs are to be placed shall be shown by the owner, but shall be as approved by the design review board. . Eagle City Code Section 8-2A-8(C)(5)(e) Any freestanding single tenant building within a shopping center shall be permitted a monument sign. The height of any such sign, including the base to which it is attached, shall not exceed six feet (6'). Eagle City Code Section 8-2A-8(E) The design review board must find that any illuminated sign permitted under the specific regulations within this chapter is designed such that brightness levels are controlled to assure a soft, subtle effective light in accordance with other city regulations intended to create and maintain the Eagle Architecture theme. Illumination types, styles, and practices not listed herein shall be prohibited unless otherwise deemed by the Design Review Board and City Council to be consistent with the Eagle Architecture theme. . Eagle City Code Section 8-2A-8(K)(1) No signs shall be erected or maintained in any district as established by the Zoning Ordinance except those signs specifically enumerated in this Chapter. The number and area of signs as outlined in this Chapter are intended to be maximum standards which do not necessarily ensure architectural compatibility. Therefore, in addition to the enumerated standards, consideration shall be given to a sign's relationship to the overall appearance of the subject property as well as the surrounding community. Compatible design, simplicity and sign effectiveness are to be used in establishing guidelines for sign approval. C. DISCUSSION: . The site has frontage on three streets: Highway 44, Edgewood Lane, and Iron Eagle Drive. The project consists of two buildings with associated parking. Anticipated uses are a 4,290-square foot single-tenant building with frontage on Highway 44 and a 10,370-square foot multi-tenant retail building with frontage on Iron Eagle Drive and Edgewood Lane. . The building along Highway 44 is to be a freestanding single tenant building (anticipated to be used by Mountain West Bank) which is allowed signage on two different building elevations. The applicant proposes to have one building wall sign on the north elevation and one on the east elevation. The locations and the allowable area for the tenant signs is shown on the Master Sign Plan Elevations date stamped by the City on January 19, 2006. . The multi-tenant retail building's proposed at the comer of Iron Eagle Drive and Edgewood Lane. All the businesses housed in this building are allowed a maximum of one wall sign that are all located on the south elevation, except for the business located in the far east suite of the building. Since this suite has two frontages, Eagle City Code allows this tenant to have two wall signs, one on the south and one on the east. The locations and allowable area for tenant signs is shown on the Master Sign Plan Elevations date stamped by the City on January 19, 2006. . The project is defined as a shopping center and is allowed one monument sign per street frontage. The applicant is proposing two monument signs, one on Edgewood Lane and one on Iron Eagle Drive shown on the "Master Sign Plan - Site Plan" date stamped by the City on January 19, 2006. Both monument signs have been proposed at the edge of the sidewalk. The applicant should provide revised landscaping plans showing a minimum of three feet (3') between the base of the monument sign and the sidewalk in order to incorporate landscaping. The revised landscape plan shall be reviewed and approved by staff prior to the city issuing a sign permit. . The design and materials for the monument signs are shown on the Monument Signs Details. The size and height restrictions are in compliance with the Eagle City Code. The applicant has decided that both double faced monument signs will be dedicated to the single-tenant building, which is anticipated to be occupied by Mountain West Bank. The monument signs will not be used by any of the tenants within the multi-tenant retail building. Landscaping comprising three times the sign single face area is provided in compliance with the sign ordinance. . Each tenant shall be required to submit signage plans to the building's managing entity for written approval. A design review sign application, accompanied by the written approval of the managing entity, shall be submitted to the City for any proposed signs for City staff review and approval. All signs shall be in compliance with the criteria stated herein as well as Eagle City Code. In cases of any conflict between Eagle City Code and the criteria specified herein, the more restrictive shall apply. 2. All wiring, transformers. etc. will be concealed in the parapet framing and no electrical conduits or racewavs are permitted. 9. Any free-hanging signboards proposed under the covered porch of the multi-tenant retail building shall be a maximum of eight (8) square feet each. A maximum of one free-hanging signboard per tenant shall be permitted. If any such sign overhangs a walkway a minimum of 7-feet 6-inches shall be maintained between the bottom of the sign and the walkway. 10. Upon termination of their lease, the tenant or managing entity shall neatly seal all penetrations of the building structure in a watertight condition that matches the texture, color, and material used in the construction of the building. 14. Directional signage will onlv be allowed for designation of the route of travel to the anticipated bank drive-up window or other future drive-up use and associated warning signage to facilitate the efficient and safe movement of traffic through the development. Directional signs shall be designed as monument style signs and shall be three feet (3') high maximum. Directional signage shall not be permitted to have business identification on them. . Staff defers comment regarding design and color of all proposed signs to the Design Review Board. STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT: Based upon the information provided to staff to date, staff recommends approval with the site specific conditions of approval and the standard conditions of approval provided within the staff report. PUBLIC MEETING OF THE BOARD: A. A meeting was held on the application before the Design Review Board on March 23, 2006, at which time the Board made their decision. B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one. C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not including the applicant/representative). BOARD DECISION: The Board voted 7 to 0 to approve DR-l 1-06 for a design review application for a Master Sign Plan for a single-tenant and a multi-tenant office building, including one building wall sign for Charney Law for Dave Evans Construction, with the following staff recommended site specific conditions of approval and standard conditions of approval with text shown with underline to be added by the Board. SITE SPECIFIC CONDITIONS OF APPROVAL: I. A sign permit is required for all proposed signs within the multi-tenant retail building, single-tenant building, and monument signs prior to a sign being constructed on this site. 3. Provide revised landscaping plans showing a minimum of three feet (3') between the base of the monument sign and the sidewalk with landscaping. The revised landscape plan shall be reviewed and approved by staff prior to the City issuing a sign permit. 4. Provide revised elevations of the monument signs and directional signs showing culture stone, matching the multi-tenant retail building, at the base of the signs. The revised elevations shall be reviewed and approved bv staff and two (2) members of the Design Review Board prior to the City issuing a sign permit. 5. If the City Council approves signs on the north elevation of the multi-tenant retail building. the applicant shall provide a revised elevation of the north side of the multi-tenant retail building showing the location of the signs, the sizes of the signs. and the locations of the gooseneck light fixtures. The revised elevation shall be reviewed and approved by staff and two (2) members of the Design Review Board prior to the City issuing a sign permit. STANDARD CONDITIONS OF APPROVAL: I. A building permit/zoning permit shall be required prior to construction of any sign which is not attached to a building with an active building permit. 2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review, as stipulated in Eagle City Code (one year from the Design Review Board approval date). 3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with. All design and construction shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the Commission and/or Council. 4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may elect to take those plans to the Design Review Board and/or the Planning and Zoning Commission for review and approval. 5. Any changes to the plans and specifications upon which this approval is based, other than those required by the above conditions, will require submittal of an application for modification and approval ofthat application prior to commencing any change. 6. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the City of Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. Any modification of the approved design review plans must be approved prior to construction/installation of such changes. Failure to do so may result in the requirement to modifY the project to comply with the approved design review and/or result in the inability to issue a certificate of completion for this project. CONCLUSIONS OF LAW: 1. The application for this item was received by the City of Eagle on January 19, 2006. 2. The Board reviewed the particular facts and circumstances of this proposed design review application (DR-ll-06) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review Overlay District, and based upon the information provided with the conditions required herein, concludes that the proposed design review application is in accordance with the Eagle City Code and the Eagle Comprehensive Plan. 3. The Design Review Board recognizes that Eagle City Code allows only the tenant space within a multi-tenant building that is located on a street comer or which fronts two (2) streets is permitted to have two (2) wall signs. However, the Board unanimously supports signs and lights for all of the tenant spaces on the north side of the building to better compliment the design and look of the building as well as helping the success of the businesses within the building.
