RESOLUTION No. 06-11
A RESOLUTION OF THE EAGLE CITY COUNCIL TO V ACA TE UTILITY, DRAINAGE, AND
IRRIGATION EASEMENTS ALONG THE SIDE LOT LINES OF LOTS 8, 9, AND II, BLOCK 3,
(MERRILL SUBDIVISION NO.2) AS SHOWN ON THE ATTACHMENTS HERETO; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Bob Erland requested a vacation to the final plat of Merrill Subdivision No.2 to
remove the utility, drainage, and irrigation easements along the side lot lines of Lots 8, 9, and II, Block 3,
(Merrill Subdivision No.2); and
WHEREAS, On November 7, 2005, the Commission passed a motion recommending approval of
the vacation (V AC-03-05), with conditions, to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in the The
Valley Times on October 31,2005 and November 7, 2005; and
WHEREAS, On November 29,2005, the City Council held a public hearing on the proposed
vacation (V AC-3-05), and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MA YOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates utility, drainage, and irrigation easements along the side lot
lines of Lots 8, 9, and II, Block 3, of the final plat of Merrill Subdivision No.2, as considered, heard and
approved by the Council at its November 29, 2005, public hearing for application number V AC-03-05 and
as shown on the attachments hereto.
This Resolution shall be in full force and effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho, this 28th day of March, 2006.
