A RESOLUTION OF THE EAGLE CITY COUNCIL TO V ACA TE THE "INGRESS/EGRESS"
PLAT NOTE NUMBER 8 ON MERRILL SUBDIVISION NO.2 FINAL PLAT TO ELIMINATE
THE ACCESS EASEMENT AND RETAIN THE UTILITY EASEMENT IN PLACE FOR
(LOT 6-8, BLOCK 3) IN THE SUBDIVISION AS SHOWN ON THE A TT ACHMENTS
HERETO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Rocky III, LLC, Dave Evans requested a vacation to the final plat of Merrill
Subdivision No.2 to remove the "Ingress/Egress" plat note Number 8 relating to (Lot 6-8, Block
3) so that said easement may become a utility easement only; and
WHEREAS, The mixed use subdivision consists of 18 buildable lots, and 5 common
lots; and
WHEREAS, The 4.3-acre site is located at 1189 and 1267 East Iron Eagle Drive within
Rocky Mountain Business Park; and
WHEREAS, On October 17,2005, the Commission passed a motion recommending
approval of the vacation (V AC-4-05), with conditions, to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in
the The Valley Times on October 31, 2005 and November 7, 2005; and
WHEREAS, On November 29,2005, the City Council held a public hearing on the
proposed vacation (V AC-4-05), and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section
9-6-2 of Eagle City Code, "Vacations and Dedications".
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY
OF EAGLE, IDAHO.
The Eagle City Council hereby vacates "Ingress/Egress" in plat note Number 8, for an
access easement to Lot 6 and Lot 8, Block 3, of the final plat of Merrill Subdivision No.2, as
considered, heard and approved by the Council at its November 29, 2005, public hearing for
application number V AC-4-05 and as shown on the attachments hereto.
This Resolution shall be in full force and effect immediately upon its adoption and
approval.
