The Eagle Design Review Board having heard and taken oral and written testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions of Law; FINDINGS OF FACT: A. PROJECT SUMMARY: State Farm, represented by Chris Pecoraro with Sign A Rama, is requesting design review approval of a master sign plan for a multi-tenant office building including a building wall sign and monument sign for State Farm. The site is located on Lot 6, Block I, within Rocky Mountain Business Park No.3, on East Iron Eagle Drive. B. APPLICATION SUBMITTAL: The City of Eagle received the application for this item on October 20,2005. e. HISTORY OF RELEVANT PREVIOUS ACTIONS: None On September 13, 2005, the Eagle City Council approved a design review application for a multi- tenant office building for the site (DR-36-05). D. COMPREHENSNE PLAN PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: . Protect and enhance the small town character of the City by requiring signage which is creative and distinctive, compatible with its surroundings, and an integral component of the style and character of the building to which it relates. B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: . Eagle City Code Section 8-2A-2(B) The general theme of the Design Review Overlay District is to specify desirable building and landscape architectural styles and materials to create a sustainable and pleasing environment for residents and visitors alike. The architectural designs, materials, and graphics set forth in this article are complied to create a theme unique to the area called "Eagle Architecture". . Eagle City Code Section 8-2A-6(A)(4) Signage for any project shall provide for business identification and minimize clutter and confusion on and off the site. . Eagle City Code Section 8-2A-6(A)(4)(c) Signs are to provide effective and necessary business identification systems adapted to the building design. . Eagle City Code Section 8-2A-6(A)(4)(e) The size, location, design, color, texture, lighting, landscaping, and hours of operations of all permanent signs and outdoor advertising structures or features to insure that any such proposals do not detract from the function of, or design of, buildings, structures, surrounding properties, neighborhoods, or streets. Eagle City Code Section 8-2A-8(C)(I) Sign materials and oyerall appearance shall compliment the building architecture and colors as determined by the Design Review Board. . Eagle City Code Section 8-2A-8(C)(4)(a) A freestanding single tenant building shall be allowed two (2) wall signs, provided that, each sign is placed on a different side of the building. The entire building shall be permitted one monument sign for every street it fronts. The sides of the building on which the signs are to be placed shall be shown by the owner, but shall be as approved by the design review board. . Eagle City Code Section 8-2A-8(E) The design review board must find that any illuminated sign permitted under the specific regulations within this chapter is designed such that brightness levels are controlled to assure a soft, subtle effective light in accordance with other city regulations intended to create and maintain the Eagle Architecture theme. Illumination types, styles, and practices not listed herein shall be prohibited unless otherwise deemed by the Design Review Board and City Council to be consistent with the Eagle Architecture theme. . Eagle City Code Section 8-2A-8(K)(1) No signs shall be erected or maintained in any district as established by the Zoning Ordinance except those signs specifically enumerated in this Chapter. The number and area of signs as outlined in this Chapter are intended to be maximum standards which do not necessarily ensure architectural compatibility. Therefore, in addition to the enumerated standards, consideration shall be given to a sign's relationship to the overall appearance of the subject property as well as the surrounding community. Compatible design, simplicity and sign effectiveness are to be used in establishing guidelines for sign approval. . Eagle City Code Section 8-2A-8(M)(16) Door signs identifYing the business and/or indicating business hours, emergency phone numbers, etc., shall be permitted up to a maximum of two (2) square feet. C. DISCUSSION: . The applicant has shown on the north and south elevation plans (date stamped by the City on October 20, 2005), the typical signage locations. Each individual tenant is required to place their business identification words within one of the approved locations. Tenant signs will be allowed within the gables on the north elevation and south elevation within the building gables. . With this application, the applicant has requested approval of a monument sign. The building is located along the State Highway 44 which is an entry corridor that introduces both visitors and residents to Eagle. It is Eagle's goal to leave everyone with a favorable impression of the community as one drives through this corridor, as this area defines the design standards for the rest of the city. Therefore, site building, and landscape design is reviewed carefully through this corridor to help enhance Eagle's image. Signage is also one of the development features that is carefully reviewed. It is recognized that signage shall provide for business identification, but needs to minimize clutter and confusion on and off the site. Although monument signs are, in part, allowed by code, it is the City's intention to minimize the number of monument signs along State Highway 44 which greatly helps reduce the amount of clutter along the street. There are a couple large shopping centers along State Highway 44 that have multi-tenant monument signs for the entire center and one large mixed-use project that has the option to install some multi-tenant monument signs in the future. A majority of the single building or multi-tenant building projects Page 3 of8 K:\Planning Dept\Eaglc: Applications\Dr\2005\DR-97-05 mstr sign plan drfdoc within the entryway corridor have Master Sign Plans that prohibit monument signs. There are six buildings within the Rocky Mountain Business Center, including the subject site, which front State Highway 44. Three of these buildings already have an approyed Master Sign Plan that prohibits monument signs. It is staffs opinion that a monument sign is not appropriate at this location and a condition has been incorporated recommending that no monument signs are permitted. Staff encourages the Board to review and comment on whether a monument sign is appropriate in this location. . Staff recommends the following changes to the applicant's document titled "Subject: Rocky Mountain Business Center Block I, Lot 6, Multi-Tenant Commercial Office Building. Master Sign Plan" with strike thru text to be deleted and underlined text to be added so as to be in compliance with the City of Eagle Code. Master Sign Plan Criteria For a Multi-Tenant Office Building located on Lot 6, Block I, Rocky Mountain Business Park No.3 1. Each tenant shall be required to submit signage plans to the building's managing entity for written approval. A design review sign application, accompanied by the written approval of the managing entity, shall be submitted to the City for any proposed signs for City staff review and approval. All signs shall be in compliance with the criteria stated herein as well as Eagle City Code. In cases of any conflict between Eagle City Code and the criteria specified herein, the more restrictive shall apply. 2. The primary tenant in the building shall be allowed signage on both the North and South facing large gables of the building. Primary tenant signage shall consist of dimensional letters and one logo panel on each elevation. 3. The building signage for the primary tenant on each elevation will be 15''h x 144" w for the dimensional letters and 30" x 30" for the logo panel (approx. 21.25 square feet). Please see attached building elevations date stamped by the City on October 20. 2005. 4. The secondary tenant in the building shall be allowed signage on both the North and South facing small gables of the building. Secondary tenant signage shall consist of dimensional letters. 5. The building signage for the secondary tenant on each elevation shall not exceed 24''h x 84"w for the total of the dimensional letters (approx. 14 square feet). Please see attached building elevations date stamped by the City on October 20.2005. 6. No electrical conduits or raceways are permitted. 14. Tenant signs shall be located within the designated areas shown on the attached elevation plans date stamped by the City on October 20,2005. 15. Upon termination of their lease, the tenant or managing entity, shall neatly seal all penetrations of the building structure in a watertight condition that matches the texture, color. and material used in the construction of the building. 16. No monument signs are permitted. 17. Any other signage such as temporary grand opening, etc. shall comply with Eagle City Code. 18. Any signage on doors or windows shall comply with Eagle City Code. . Staff defers comment regarding design and color of all proposed signs, including the monument sign, to the Design Review Board. STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT: Based upon the information provided to staff to date, staff recommends approval with the site specific conditions of approval and the standard conditions of approval provided within the staff report. PUBLIC MEETING OF THE BOARD: A. A meeting was held on the application before the Design Review Board on December 22, 2005, at which time the Board made their decision. B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one. C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not including the applicant/representative). BOARD DECISION: The Board voted 6 to 0 (Wright absent) to approve DR-97-05 for a design review application for a master sign plan for a multi-tenant office building including two building wall signs and a monument sign for Steve Garringer, with the following staff recommended site specific conditions of approval and standard conditions of approval with text shown with strike thru to be deleted by the Board and text shown with underline to be added by the Board. SITE SPECIFIC CONDITIONS OF APPROVAL: 1. The following document titled "Master Sign Plan Criteria for a Multi-Tenant Office Building located on Lot 6, Block I, Rocky Mountain Business Park No.3" shall be the master sign plan criteria for the multi-tenant office building: Master Sign Plan Criteria For a Multi-Tenant Office Building located on Lot 6, Block I, Rocky Mountain Business Park No.3 1. Each tenant shall be required to submit signage plans to the building's managing entity for written approval. No monument signs are approved with this application. 4. A sign permit is required prior to a sign being constructed on this site. 5. No additional light fixtures are proposed to illuminate the building wall signs and none are approved. STANDARD CONDITIONS OF APPROVAL: I. A building permit/zoning permit shall be required prior to construction of any sign which is not attached to a building with an active building permit. 2. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with. All design and construction shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the Commission and/or Council. 4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may elect to take those plans to the Design Review Board and/or the Planning and Zoning Commission for review and approval. 5. Any changes to the plans and specifications upon which this approval is based, other than those required by the above conditions, will require submittal of an application for modification and approval of that application prior to commencing any change. 6. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the City of Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 7. Any modification of the approved design review plans must be approved prior to construction/installation of such changes. Failure to do so may result in the requirement to modifY the project to comply with the approved design review and/or result in the inability to issue a certificate of completion for this project. CONCLUSIONS OF LAW: I. The application for this item was received by the City of Eagle on October 20, 2005. 2. The Board reviewed the particular facts and circumstances of this proposed design review application (DR-97-05) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review Overlay District, and based upon the information provided with the conditions required herein, concludes that the proposed design review application is in accordance with the Eagle City Code and the Eagle Comprehensive Plan. 3. The Board recognizes State Highway 44 as an entry corridor that provides the first, and oftentimes the most lasting impressions of the entire community. As required within the 2000 Comprehensive Plan, the design review process addresses the special features of each property and facility in a manner that will best address the overall intent of enhancing Eagle's entryways. With regard to the site's overall signage, the Board recommends that no monument signs be allowed on State Highway 44 so as to provide a pristine entryway that one will remember because of the creative landscaping free of monument signs. If the City Council determines that a monument sign should be permitted along State Highway 44, the Board recommends, in the following order, the following options: I. A single monument sign, with multiple tenant panels, for all the buildings located within Rocky Mountain Business Park No.3 may be permitted along State Highway 44. This will allow tenant exposure on State Highway 44 while reducing the number of possible monument signs. The design, colors, dimensions, style, location, and required landscaping for this monument sign shall be reviewed and approved by the Design Review Board. 2. A single tenant monument sign for State Farm may be constructed of the materials, colors, and dimensions with associated landscaping as shown on the elevation and landscape plans date stamped by the City on December 13, 2005.
