FINDINGS OF FACT AND CONCLUSIONS OF LAW

The above-entitled design review application came before the Eagle Design Review Board for their action
on December 8, 2005. The Eagle Design Review Board having heard and taken oral and written
testimony, and having duly considered the matter, makes the following Findings of Fact and Conclusions
of Law;
FINDINGS OF FACT:
A. PROJECT SUMMARY:
Robert Moffat is requesting design review approval to modify the master sign plan for Heritage
Square. This modification includes constructing the monument sign with a stone wainscoting,
stucco background, and placing the cast monograms on a decorative backpanel. The site is located
on the north side of East State Street approximately 190-feet west of Stierman Way at 430 East
State Street.
B. APPLICATION SUBMITTAL:
The City of Eagle received the application for this item on December 5,2005.
e. HISTORY OF RELEVANT PREVIOUS ACTIONS:
On September 9, 2003, the Eagle City Council approved a master sign plan for Heritage Square
(DR-28-03).
On September 26, 2005, Eagle City Staff approved a modification to the master sign plan for
Heritage Square (DR-28-03 MOD).
STAFF ANALYSIS PROVIDED WITHIN THE STAFF REPORT:
A. COMPREHENSIVE PLAN PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING
THIS PROPOSAL:
. Protect and enhance the small town character of the City by requiring signage which is creative
and distinctive, compatible with its surroundings, and an integral component of the style and
character of the building to which it relates.
B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS
PROPOSAL: None
e. DISCUSSION:
. The entire monument sign for Heritage Square, as originally approved by the Council on
September 9, 2003, was to be constructed of stone to match that which was used in the
construction of the buildings (see attached elevation plan date stamped by the City on June 5,
2003). On September 26, 2005, City Staff approved a modification to the master sign plan to
include tenant panels on the monument sign and building wall signs on the south elevation of
building number three (see attached elevation plan date stamped by the City on July 8, 2005).

The purpose of this modification is to remove the requirement to have the entire monument sign
constructed of stone and to construct the monument sign with a stone wainscoting with a stucco
background while installing the cast monograms, as originally approved on the columns, on a
decorative backpanel to fill the vacant space on the columns of the sign. The applicant indicates
within his email dated December 5,2005, that the stone is too dark and that the contrast between
the stone and the name of the development and the clock will not be enough to provide for an
adequate appearance for the tenants within Heritage Square.
Staff defers comment regarding the design and materials to be used in the construction of the
monument sign to the Design Review Board.
PUBLIC MEETING OF THE BOARD:
A. A meeting was held on the application before the Design Review Board on December 8, 2005, at
which time the Board made their decision.
B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one.
C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not
including the applicant/representative).
BOARD DECISION:
The Board voted 6 to 0 (McCullough absent) to deny DR-28-03 MOD for a design review
application to modify the master sign plan for Heritage Square for Robert Moffat based on the
modified monument design does not fit with the environment and quality of the project as well as
the original design which incorporated the stone on the entire face of the monument sign.
CONCLUSIONS OF LAW:
1. The application for this item was received by the City of Eagle on December 5, 2005.
2. The Board reviewed the particular facts and circumstances of this proposed design review application
(DR-28-03 MOD) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design
Review Overlay District, and based upon the information provided, concludes that the proposed design
review application is not incompliance with Eagle City Code and the Eagle Comprehensive Plan for
the proposed modification does not meet the quality of the original project design that incorporated
stone on the entire face of the monument. The Board recommended that the applicant construct the
face of the sign with stone, use a stone or pre-cast concrete cap for the roof, and construct the tenant
panel between the columns of the sign, as approved by staff.
