FINDINGS OF FACT AND CONCLUSIONS OF LAW

The above-entitled design review application came before the Eagle Design Review Board for their action
on September 8, 2005. The Board continued the item to October 13, 2005, and made their decision at that
time. The Eagle Design Review Board having heard and taken oral and written testimony, and having duly
considered the matter, makes the following Findings of Fact and Conclusions of Law;
FINDINGS OF FACT:
A. PROJECT SUMMARY:
Carmen, LLC and Gemstar Development, LLC, represented by Gina Fegler with The Land Group,
are requesting design review approval to construct four monument signs at the entries to Corrente
Bello Planned Unit Development. The 94.89-acre site is located on the north side of Floating
Feather Road approximately Yo-mile west of Eagle Road on the west and north sides of Eagle
Middle School.
B. APPLICATION SUBMITTAL:
The City of Eagle received the application for this item on August 4, 2005.
C. HISTORY OF RELEVANT PREVIOUS ACTIONS:
On August 9, 2005, the Eagle City Council approved a conditional use, preliminary development
plan, and preliminary plat application for Corrente Bello Planned Unit Development (RZ-7-
05/CU - 3-05/PPUD- 2-05/PP-7 -05).
D. COMPANION APPLICATIONS:

G. SIGN MATERIALS:
CMU with culture stone (chardonnay dressed fieldstone - csv-2042) and stucco veneer and timber
accents. Wrought iron lettering with a copper grape design. Terra cotta style roof.
STAFF ANALYSIS PROVIDED WITHIN THE STAFF REPORT:
A. COMPREHENSIVE PLAN PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING
THIS PROPOSAL:
. Protect and enhance the small town character of the City by requiring signage which is creative
and distinctive, compatible with its surroundings, and an integral component of the style and
character of the building to which it relates.
B. ZONING CODE PROVISIONS WHICH ARE OF SPECIAL CONCERN REGARDING THIS
PROPOSAL:
. Eagle City Code Section 8-2A-5(c)
Monument signs located within the entire design review overlay district, excluding monument
signs within the DDA, IDA, and "shopping centers" shall not exceed eight feet (8') in height
(including the solid base) measured from the centerline of the adiacent roadwav or top of curb,
if one exists.

Subdivision monument signs shall be a maximum of eight feet (8') high and shall have a
maximum surface area of fifty (50) square feet. A sign may be permitted on each side of any
entry road into a subdivision and at the intersection of any collector and/or arterial streets

C. DISCUSSION:
. The applicant is proposing to install four (4) monument signs within Corrente Bello Planned
Unit Development. The applicant is proposing two (2) different styles of monument signs
noted as Type A and Type B. Two (2) Type A monument signs are proposed to be located at
the intersection of Costa Bello Street and Corrente Bello A venue. One Type A monument sign
is proposed to be located within the landscaped island on Costa Bello Street and the other
Type A monument sign is proposed to be located in the landscaped island on Corrente Bello
A venue.
Eagle City Code allows monument signs to be located at any entry road into a subdivision and
at the intersection of any collector and/or arterial streets abutting the subdivision. Costa Bello
Street could be interpreted to be an entry road into a subdivision according to Eagle City Code,
thus a monument sign could be located within the landscape island. However, the monument
sign located in the landscape island within Corrente Bello A venue, north of Costa Bello Street,
would be one of two proposed monument signs to be located on Corrente Bello A venue. City
Staff recommends that the monument sign proposed within the landscaped island on Corrente
Bello A venue, north of Costa Bello Street, be located within the roundabout of Corrente Bello
Avenue, Monte Bello Drive, and Vista Bello Way, due to the close proximity of the
monument sign located at the intersection of Floating Feather Road and Corrente Bello
A venue. The applicant should be required to provide a revised landscape plan showing the
Type A monument sign to be located within the roundabout of Corrente Bello A venue, Monte
Bello Drive, and Vista Bello Way. The revised landscape plan should be reviewed and
approved by the Design Review Board prior to the City issuing a sign permit for this site.
. The applicant is proposing to construct two (2) Type B monument signs along Floating
Feather Road (one (1) at each entrance). Sheet L2.1, date stamped by the City on August 4,
2005, shows the overall height of the Type B monument signs to be II' 10". Per Eagle City
Code, subdivision monument signs are permitted to be a maximum of eight feet (8') high. The
proposed Type B monument signs exceed the maximum height allowed by Eagle City Code by
approximately 50%. Although the proposed Type B monument signs may provide an
ambience to the development there are no provisions within Eagle City Code to allow a
subdivision monument sign to be constructed at a height of 11'10". The applicant should be
required to provide a revised elevation plan showing the overall height of the Type B
monument signs do not exceed eight feet (8'). The revised elevation plans should be reviewed
and approved by the Design Review Board prior to the City issuing a sign permit for this site.
. Staff defers comment regarding the number of signs, locations, size and the height of the Type
B signage to the Design Review Board.
STAFF RECOMMENDATION PROVIDED WITHIN THE REPORT:
Based upon the information provided to staff to date, staff recommends approval with the site
specific conditions of approval and the standard conditions of approval provided within the staff
report.
PUBLIC MEETING OF THE BOARD:
A. A meeting was held on the application before the Design Review Board on September 8, 2005. The
application was continued to October 13, 2005, at which time the Board made their decision.
B. Oral testimony in opposition to this proposal was presented to the Design Review Board by no one.
C. Oral testimony in favor of this proposal was presented to the Design Review Board by no one (not
including the applicant/representative).

BOARD DECISION:
The Board voted 6 to 0 to approve DR-73-05 for a design review application to construct four
monument signs for Corrente Bello Planned Unit Development for Carmen LLC and Gemstar
Development LLC, with the following staff recommended site specific conditions of approval and
standard conditions of approval with text shown with strike thru to be deleted by the Board and
text shown with underline to be added by the Board.

2. Provide a revised cut sheet showing high pressure sodium lighting to be used within the proposed
ground mounted light fixtures. The revised cut sheets shall be reviewed and approved by staff prior to
the issuance of a sign permit.
3. The light fixtures shall be concealed or screened with perimeter landscaping providing a l2-month
screen of sufficient height and density to conceal such fixtures. They shall also be screened or located
so they do not shine onto the roadway or any nearby property.

5. Interior illumination is not permitted for monument signs.
6. A sign permit is required prior to a sign being constructed on this site.
7. Provide a revised landscape plan showing the berm height to be a minimum of six feet (6') in height
behind the Type B monument signs. The evergreen trees proposed on top of the six foot (6') high berm
shall be a minimum of ten feet to twelve feet (10' -12') in height. The variety of evergreen trees and the
revised landscape plan shall be reviewed by staff and one member of the Design Review Board prior to
the City signing the final plat.
STANDARD CONDITIONS OF APPROVAL:
I. A building permit/zoning permit shall be required prior to construction of any sign which is not
attached to a building with an active building permit.
2. Approval shall expire without notice to the applicant on the date of expiration of this Design Review,
as stipulated in Eagle City Code (one year from the Design Review Board approval date).
3. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable
County, State and Federal Codes and Regulations shall be complied with. All design and construction
shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the
Commission and/or Council.
4. New plans which incorporate any required changes shall be submitted for staff approval. Staff may
elect to take those plans to the Design Review Board and/or the Planning and Zoning Commission for
review and approval.
5. Any changes to the plans and specifications upon which this approval is based, other than those
required by the above conditions, will require submittal of an application for modification and

approval of that application prior to commencing any change.
6. Any change by the applicant in the planned use of the property which is the subject of this application,
shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory
and legal restrictions in force at the time the applicant or its successors in interest advises the City of
Eagle of its intent to change the planned use of the subject property unless a waiver/variance of said
requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is
sought.
7. Any modification of the approved design review plans must be approved prior to
construction/installation of such changes. Failure to do so may result in the requirement to modify the
project to comply with the approved design review and/or result in the inability to issue a certificate of
completion for this project.
CONCLUSIONS OF LAW:
1. The application for this item was received by the City of Eagle on August 4, 2005.
2. The Board reviewed the particular facts and circumstances of this proposed design review application
(DR-73-05) with regard to the Eagle City Code Title 8, Chapter 2, Article A, DR Design Review
Overlay District, and based upon the information provided with the conditions required herein,
concludes that the proposed design review application is in accordance with the Eagle City Code and
the Eagle Comprehensive Plan.
3. The Board recognizes the fact that the Type B monument signs exceed the overall height allowed by
Eagle City Code. However, the Board recommends the monument signs as designed be approved
because the additional berm height and taller evergreen trees will provide a backdrop to the monument
signs that will bring the monument signs into scale.
