IN THE MATTER OF THE
1992 AMENDMENTS TO THE
EAGLE COMPREHENSIVE PLAN
FINDINGS OF FACT
AND CONCLUSIONS
OF LAW
On August 17, 1992, pursuant to public notice and hearing
procedures set forth in Section 67-6509 and 67-6525, Idaho State
Code, and Title 50 a public hearing was held to consider the 1992
amendments to the Eagle Comprehensive Plan and the inclusion of a
"Land Use Designation Map" before the Eagle Planning and Zoning
Commission. The public hearing was held in an "open forum" public
hearing from l:OO p.m. to 7:00 p.m., the public was invited to give
oral testimony before a hearing officer or to submit written
testimony.
Based upon the oral and written evidence submitted at the hearing
before it,the recommendation of the Eagle Planning and Zoning
Commission was as follows:
FINDINGS OF FACT:
1.
The records in this matter indicate all notices, and
publications has occurred as required by law. The records
further reflect notice of the public hearing was published in
the Valley News, Meridian, Idaho, the official newspaper for
the City of Eagle.

On August 17, 1992, a public hearing on the proposed
amendments to the 1990 Eagle Comprehensive Plan, and the Land
Use Designation Map was presented to the public.

The public had concerns to the proposed plan regarding the
development impact on the community, the schools, traffic
conditions and water concerns in the Eagle area.
The City of Eagle boundaries border to the NE at Beacon Light
Rd, to the NW Floating Feather Rd, to the SE by Chinden Blvd.
Rd. to the SW by section line, to the W by Ballantyne Rd and
section line and to the E by Highway 55 and section line. The
Eagle Impact Area is bordered to the N by Homer Rd, to the S
by Chinden Blvd., to the E by Highway 55 and to the W by
Linder Rd.
CONCLUSION
1.
The Eagle Planning and Zoning Commission concluded that the
amendments to the 1990 Eagle Comprehensive Plan are consistent
with the intent and purpose of the Idaho State Code, Title 67
and promotes the health, safety and general welfare of the

people. The plan serves public welfare and that the
combination of various land uses presented in the "Land Use
Designation Map" serves the best interest to protect and
enhance property values.
RECOMMENDATION
Based upon the foregoing FINDINGS OF FACTS AND CONCLUSIONS OF LAW,
The Eagle City Council approves the proposed 1992 amendments to the
Eagle Comprehensive Plan and "Land Use Designation Map" as
presented with the following modifications:
The 1992 Eagle Comprehensive Plan and Land Use Designation Map will
include the category "A", Agricultural, along with the designations
presented, and those changes reflected in the amended Land Use
Designation Map on density to "very low density~.
