FINDINGS OF FACT
1) On December 3, 1984, TW Investments, a general partnership of
John Robison and Richard Bechtold, applied for a subdivision of forty-
one lots on approximately 9069 acres along the West side of Edgewood
Lane and South of the Eagle Hills Golf Courseo In their preliminary
application the applicant's requested a variance concerning one en-
trance to the Subdivision and a variance to allow for additional
length of cul-de-sac streetso
2) On January 22, 1985, following the notice and hearing pro-
cedures required by #67-6509, Idaho Code and the requirements contained in
Ordinance #88, Chapter 3, Section g, the Eagle Planning and Zoning Com-
mission held a public hearing concerning the applicationo
3) At the public hearing unfavorable testimony was received from
eight property owners and the Commission voted to delay their decision
until the next regular meeting in Februaryo
4) At the Planning and Zoning Commission meeting of February 5th,
1985, the Commission voted to recommend to the City Council that the
preliminary application not be favorably consideredo
CONCLUSIONS OF LAW
1) The preliminary application of TW Investments does not comply
with paragraph three of the Goals as set forth in the Section titled
"Public Services, Facilities, and Utilities" of the Eagle Comprehensive
Plan.
