BOX 477 - EAGLE, IDAHO 83616 - PHONE 939-6813 Robert DeShazo Builders ) ) ) ) ) Findings of Fact and Conclusions of Law In the Matter of Conditional Use Permit FINDINGS OF FACT 1) On or about October 31, 1983, Robert DeShazo Builders Inc., applied for a Conditional Use Permit in which it requested that a parcel of property generally described as being on the Southeast corner of the intersection of Ranch Drive and North Eagle Road, Eagle, Idaho, be utilized for the construction of three two-story townhouses for a total of 24 units. 2) On January 3, 1984, a hearing was held before the Eagle City Planning and Zoning Commission to consider the Robert DeShazo Builders Inc. Conditional Use Permit Application. The Commission, following presentation by Robert Maxey of the plans, voted to deny the application for the following reasons: A. The Conditional use permit is not necessary to accomplish what is asked for in the application: and B. The plans as set forth in the application are not in keeping with the Comprehensive Plan of the City of Eagle. Based upon the foregoing Findings of Fact the Eagle Planning and Zoning Commission voted to reco~mend to the City Council that the application be denied. The denial of the permit is based upon the following: CONCLUSIONS OF LAW 1) The application of Robert DeShazo Builders Inc. does not comply with the requirements for submission of an application for a Conditional Use Permit as set forth in Article XI of the Eagle City Zoning Ordinance. 2) The proposed use as contemplated in the Conditional Use Permit Application is not in accordance with the Eagle Comprehensive Plan. 3) For the reasons previously stated it is appropriate that a Conditional Use Permit be denied of Robert DeShazo Builders Inc. based upon those considerations contained in Section C, Paragraph 1 and 2, Article XI of the Eagle City Zoning Ordinance relating to Conditional Use Permits in general.
