Ordinance - 1997 - 286 - Amend Title 2 - 01/28/1997ORDINANCE NO. 286 AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY, IDAHO ADDING TITLE 2, CHAPTER 4 TO THE EAGLE CITY CODE PROVIDING FOR THE APPOINTMENT OF BOARDS AND COMMISSIONS OF THE CITY OF EAGLE. WHEREAS the City of Eagle desires to establish a policy for the appointment of members to all committees, Boards or Commissions not specifically identified by Statute of the Eagle City Code; and WHEREAS the policy is to provide for appointment procedures similar to the appointment powers for permanent boards, commissions, and committees set forth in Idaho Code Section 50- 210 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF EAGLE, Ada County, Idaho; Section 1: That a new Chapter 4, Title 2 be and hereby is enacted to read as follows: 2-4-1: Board Creation, Tenn and Qualifications: All boards, commissions or committees providing advice to, or acting on behalf of, the City of Eagle and not otherwise specifically set forth in the Eagle City Code shall be created by resolution of the Council. Such resolution shall include the term of the board, commission, or committee, the number and qualifications, if any, of the members and the terms of office of each member. 2-4-2: Appointment, Vacancies, and Removal - Members of boards, commissions and committees created by the Council shall be appointed by the Mayor and confirmed by a majority vote of the Council. All vacancies shall be filled in the same manner as original appointments, and members may be removed by a majority vote of the Council. 2-4-3: Refusal to Confirm Appointments: If the City Council shall refuse to confirm any nomination, the Mayor shall then, within ten (10) days thereafter, nominate another person to fill the board, commission, or committee position and the Mayor may continue to nominate until the Mayor's nominee is confirmed. If the Mayor fails to 1019\2\appoint.ord make another nomination for the same position within ten (10) days after the rejection of a nominee, the City Council shall appoint a suitable person to fill the office during the term. The affirmative vote of one-half (1/2) plus one (1) of the members of the full council shall be required to confirm any nomination made by the Mayor. Section 2: This ordinance shall take effect and be in force from and after its passage, approval, and publication as required by law. In lieu of publication of the entire Ordinance, a summary thereof in compliance with Section 50-901A, Idaho code, may be published. DATED thiso?81day of January, 1997.
