Ordinance - 1997 - 284 - Amend Title 2; Design Review Committee Scope - 01/28/1997ORDINANCE NO. 284 AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, REPEALING EXISTING TITLE 2, CHAPTER 2, SECTIONS 2-2-1, 2-2-2, 2-2-3, AND 2-2-4 OF THE EAGLE CITY CODE, AND ADDING TITLE 2, CHAPTER 2, SECTIONS 2-2-1, 2-2-2, 2-2-3, AND 2-2-4 OF THE EAGLE CITY CODE, PROVIDING FOR THE CREATION AND QUALIFICATIONS OF THE DESIGN REVIEW COMMITTEE, PROVIDING TERMS OF OFFICE AND PROVISIONS FOR FILLING VACANCIES, PROVIDING FOR ORGANIZATION REQUIREMENTS; AND PROVIDING FOR DEFINITIONS OF THE SCOPE OF DUTIES, JURISDICTION AND AUTHORITY: Section 1: That Title 2, Chapter 2, Sections 2-2-1 through 2-2-4, Eagle City Code, be, and the same hereby is, repealed. Section 2: That a new Title 2, Chapter 2 of the Eagle City Code be and hereby is enacted to read as follows: 2-2-1: BOARD CREATED MEMBERSHIP, QUALIFICATIONS: The Design Review Board shall function on behalf of the City Council. The Board shall be composed of five (5) members, and one (1) non-voting member which shall be from the City Council. Members shall be appointed by the Mayor and confirmed by the City Council. Members of the Board shall be appointed with proper representation from such fields as architecture, landscape architecture, business, engineering, and a citizen -at -large. The Zoning Administrator, upon consent of the City Clerk, may seek assistance from other such employees of the city as is necessary to fulfill the duties of the Design Review Board. 2-2-2 TERMS OF OFFICE, VACANCIES: The members of the Board shall take office as of the date of their appointment, confirmation, and qualification. The term of the appointment shall be for three (3) years, with the exception of the City Council representative who shall serve a term of up to one (1) year as defined by the City Council. All members shall be eligible for reappointment. In the event of a vacancy of a position on the Board, the Mayor shall appoint a new member, with the consent of the City Council, for the balance of the unexpired term. 2-2-3: ORGANIZATION: The Board shall designate a chairman from its membership and shall adopt the public hearing procedures as outlined in Sections 1-8-3A and 1-8-3E, Eagle City Code. The Board shall meet on the second (2nd) and fourth (4th) Thursday of each calendar month, unless a Holiday occurs at which time the meeting shall be re -scheduled to the next regularly scheduled meeting date. The chairman shall designate a secretary to keep the minutes of all official meetings. All meetings shall be opened to the public. Minutes shall be typed by the City Clerk or designee, with copies approved at the next regularly scheduled meeting. All Board documents shall be made available to the public subject to the Public Records Laws. 2-2-4: DUTIES, JURISDICTION, AND AUTHORITY: It shall be the responsibility of the H:\COUNCIL\ORDINANC\DESREV 1.284 1 Board to protect property rights, and values, enhance important environmental features of the city, and to ensure that the general appearance of buildings and structures, along with development of the land, shall not impair or preclude the orderly and harmonious development of the community. The Board shall review all development proposals within the Design Review District. Within this district, the Board, with input from the Zoning Administrator, shall regulate landscaping and beautification laws, review building design, and review site planning, signs, grading, development. This includes, but is not limited to the regulation and restriction of the type of building, number of stories, size of building, construction, reconstruction, alteration, repair, or use of buildings and structures. The Board shall ensure compliance with the requirements of the respective Design Review Overlay Districts, City of Eagle Comprehensive Plan, and relevant Ordinances. Lack of a quorum of Board members shall require review of pending business by City Council at their next regularly scheduled meeting, which shall be provided legal notice pursuant to law. Section 3: This ordinance shall take effect and be in force from and after its passage, approval, and publication as required by law. In lieu of publication of the entire Ordinance, a summary thereof in compliance with Section 50-901A, Idaho Code, may be published.
