AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, AMENDING
TITLE 1, CHAPTER 9, SECTION 1-9-5, EAGLE CITY CODE BY ENACTING A
SECTION ESTABLISHING A PROCEDURE FOR A RUNOFF ELECTION IN THE
EVENT THAT NO SINGLE CANDIDATE RECEIVES A MAJORITY OF THE VOTES
CAST IN AN ELECTION FOR THE OFFICE OF MAYOR OF THE CITY OF EAGLE,
PURSUANT TO THE AUTHORITY ESTABLISHED BY SECTION 50-612, IDAHO
CODE.
WHEREAS Section 50-612, Idaho Code, authorizes the passage of an
ordinance by cities within the State of Idaho establishing that a runoff election be held
following an election for the office of mayor when no single mayoral candidate receives
a majority of the votes cast in an election;
THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE
CITY OF EAGLE, ADA COUNTY, IDAHO, AS FOLLOWS:
Section 1: That the a new section, Section 1-9-5, Chapter 9, Title 1, Eagle
City Code, be and the same is hereby enacted to read as follows:
1-9-5: RUNOFF ELECTION
A. In an election for the office of Mayor, if no single candidate receives a
majority of the votes cast, there shall be a runoff election between the two (2)
candidates receiving the highest number of votes cast.
B. The City Clerk shall exercise general supervision of the runoff election,
and shall conduct the runoff election in the same manner as general elections
are conducted within the city, subject to the following exceptions;
1. The runoff election shall be held within thirty (30) days of the
previously -held election resulting in the need for a runoff election.
2. The requirements of Section 34-106, Idaho Code, shall not apply to
the runoff election.
Section 2: That this Ordinance shall take effect and be enforced after its
passage, approval, and publication as required by law. In lieu of publication of the
entire ordinance, a summary thereof, in compliance with Section 50-901A, Idaho Code,
may be published.{
