Ordinance - 1996 - 271 - Amend Title 8-2-3 - 01/23/1996CITY OF EAGLE ORDINANCE NO. % ORIGINAL AN ORDINANCE OF THE CITY OF EAGLE AMENDING EAGLE CITY CODE SECTION 8-2-3, OFFICIAL SCHEDULE OF DISTRICT REGULATIONS, TO PROHIBIT DRIVE-IN RESTAURANTS IN THE CENTRAL BUSINESS DISTRICT AND CONDITIONALLY ALLOW THEM IN C-2 AND C-3 DISTRICTS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED, by the Mayor and City Council of the City of Eagle, Idaho as follows: Section 1: That Eagle City Code Section 8-2-3, be, and the same hereby is, amended to read as follows: 8-2-3: SCHEDULE OF DISTRICT USE REGULATIONS: District Regulations and in the performance standards in Chapter 3 of this Title. The Official Schedule of District Regulations is divided into four (4) land use groups: agricultural, residential, commercial and industrial. To determine in which district a specific use is allowed: A. Find the use in one of the groups; B. Read across the chart until either "P" or "C" appears in one of the columns; and C. If "P" appears, the use is an allowed use; if "C" appears, the use is only allowed upon the issuance of a conditional use permit. The Administrator shall interpret the appropriate district for land uses not specifically mentioned by determining the district in which similar uses are permitted. When several combined land uses exist, or are proposed, the most intensive land use shall be considered as the primary activity.
