(Grantor), does hereby give and grant unto the CITY OF EAGLE, municipal
corporation of the State of Idaho, P.O. Box 1520, Eagle, Idaho, 83616,
(Grantee) exclusively and solely for use by the general public, a greenbelt
easement that could include a paved path for non-motorized vehicles, horses and
pedestrian use.
There are no implied easements across the Grantor's land to access this
easement nor does the Grantee guarantee any access to this easement.
Property Description: See Exhibit "A"
This easement is subject to easements, restrictions, and reservations of record.
It being the intent of this easement to describe the changes of the north (right)
bank of the north channel of the Boise River, due to typical meandering, as set
forth in Acquired Easement No. 345, recorded as Inst. #94062333, records of
Ada County. The easement shall move with any changes of the river bank that
may occur over time.
To have and to hold the said easement unto the CITY OF EAGLE, for the
purposes herein above described, its successors and assigns forever. If, for any
reason, the easement fails to be used for its intended use as a greenbelt for the
benefit of the general public, this easement shall revert to the State of Idaho for
the purpose of a public access greenbelt.

LAND DESCRIPTION
Greenbelt Easement across Rock Contractors, Inc.
A strip of land twenty-five (25) feet wide, all lying northerly of, along and adjacent to a line
in the SW1/4SW1/4 of Section 15, Township 4 North, Range 1 East, B.M., Ada County, Idaho,
City of Eagle; said line being more particularly described as follows:
Commencing at the northeast corner of Government Lot 4 (CW1/16 corner) of said Section
15;
thence SOo042'll"W 1549.87 feet along the east line of said Government Lot 4, and the
southerly extension thereof, to a point on the ordinary high water mark of the north (right)
bank of the North Channel of the Boise River and the POINT OF BEGINNING of the
aforementioned line;
thence N47°21'13"W 108.40 feet;
thence N64°14'04"W 160.00 feet to a point on the ordinary high water line, as described in
Inst. #94062333, records of Ada County, said course being described as "South 50°20'40" East,
249.64 feet" in said Instrument, to the POINT OF TERMINUS.
The above described area containing 0.149 acres, more or less.
It being the intention that the west end of the north line of the twenty-five (25) foot wide
strip described herein be extended or shortened to terminate on the north line of the twenty-
five (25) foot wide strip as described in said Instrument #94062333, records of Ada County,
and the east end of the north line be extended or shortened to terminate on the southerly
extension of east line of said Government Lot 4.
The basis of bearing for this description being record of survey number 6864 recorded at
Instrument Number 105043786, records of Ada County.
