EAGLE CITY COUNCIL
Special Meeting Minutes
March 30, 2005
1. CALL TO ORDER: Mayor calls the meeting to order at 5:40 p.m.
2. ROLL CALL: BASTIAN, SEDLACEK, GUERBER, NORDSTROM. Sedlacek is absent.
A quorum is present.
3. EXECUTIVE SESSION:
A. Pending or threatened litigation: I.c. §67-2345(f)
Mayor introduces the issue.
Bastian moves to go into Executive Session for the discussion of pending or threatened
litigation. Seconded by Guerber. Bastian: AYE; Guerber: AYE; Nordstrom: AYE: ALL
AYES: MOTION CARRIES........................
Council discusses pending or threatened litigation.
Councilleaves Executive Session at 6: 1 0 p.m.
Bastian moves to authorize the Mayor to send a settlement letter to ITD in regards to
access to the By-Pass with the following conditions: that Eagle be allowed a right-in right-
out on both the North and South sides which will be aligned and that no additional studies
are needed and that any charges or fees for an application be part of the settlement.
Seconded by Nordstrom. Discussion. Bastian amends the motion to state: that if the
Director of ITD accepts these terms in writing then the City of Eagle agrees to drop the
lawsuit against lTD. Second concurs. ALL AYES: MOTION CARRIES...............
Discussion on Industrial Development Bonds.
4. ADJOURNMENT:
Bastian moves to adjourn. Seconded by Guerber. ALL AYE: MOTION CARRIES...
Hearing no further business, the Council meeting adjourned at 6:20 p.m.
