FINDINGS OF FACT
AND CONCLUSIONS
OF LAW
Pursuant to public notice and hearing procedures set forth in Section 67-6509, Idaho Code, a
public hearing was held before the Eagle Planning and Zoning Commission to consider
amendments to the Eagle Comprehensive Plan (the "Plan").
The petitioned amendments to the Plan were the following applications:
1. APPLICANT: Keith & Ona Ricks, Merle & Gladys Hazen
ADDRESS: % Tom Ricks, 101 Park Ln., Eagle
lYPE OF APPLICATION: Comprehensive Plan Map revision from very low density residential
to medium density residential
LOCA nON: E of the new Eagle high school
2. APPLICANT: Wanner/Buckner
ADDRESS: 4225 Riva Ridge Dr., Boise, Id. 83709
lYPE OF APPLICATION: Comprehensive Plan Map revision from very low density residential
to medium density residential
LOCATION: N of Floating Feather Rd., W of Eagle Rd., W of new Eagle middle school
FINDINGS OF FACT:

City of Eagle boundaries border to the NE at Beacon Light Rd., to the N Floating
Feather Rd., to the SE by Chinden Blvd., to the SW by section line, to the W by
Ballantyne Rd. and section line, and to the E by Highway 55 and section line. The
Eagle Impact Area is bordered to the N by Homer Rd., to the S by Chinden Blvd., to
the E by Highway 55, and to the W by Linder Rd.

On February 27, 1995, a public hearing was held on the above petitioned amendments
and other proposed amendments to the 1993 Eagle Comprehensive Plan. Continued
or further hearings were held on March 6, 1995, March 20, 1995, April 3, 1995, and
May, 1995.

The records in this matter indicate all mailed notices and publications occurred as
required by law. Notice of the public hearing was published in the Valley News,
Meridian, Idaho, the official newspaper for the City of Eagle.

Responses ftom political subdivisions and govenuucntal agencies were as follows:
CENTRAL DISTRICT HEALTII: Sewer services should be extended (re&ence
both applications). Stonnwater management reçommendations made.
EAGLE SEWER DIST. The W8III1er/Buckner property is within the Planoing
Boundaries fur the Sewer Di&trict and has been IIDDexed into the service boundaries.
The RicksIIIa2en properties lie W of the section line (SeGtÏODs 7 and 12), which
places both properties outside the Planning Boundaries, ma1cing the properties
~~ñ1e fOr sewer seMœ. The District is reviewing the plann1ng area to investigate
the possibility of expanding the bO1111dmes. Areas W of the treatInœt plant are
d1fficult and more expensive to serve.. The area is lower than the treatment facility
and gnvÏty seMce is not m optÏoIL The western portion of the Plamüng Boundaries
require lift stations and pressurized seweI' lines to &ci1itate moving the sewage.
Consistent zonÏng TCqUirements arc critical to the District's planning efforts.
MERIDIAN SCHOOL DISTRICT: The District retmned COIIUldlt!j regarding school
projections, corrections, and a copy ofMeridian.'s Coœprchensive Plan.

Public oral testimony and. written testimony were reœived throughout the hearing
process.

Based upon the above testimony the Planning and Zoning Commi!O:s1on finds that:
rn~nffiç1eut evidence has been provided regarding substlm1'i~1 changes in actual
conditions in the subject areas to justify ('.'h~nges in the Plan at this time..Sewer
capacity is an issue. Concerns a1so exist about the data provided on the impact on
schools and the popu1ation.
CONCLUSION
The P1RnnÚtg and 7æing C~ concludes it is not in the best interest of the
City of Eagle to approve the appJications received ftom RicbIHazen and
WannerlBuclmer and IeÇOmnu'!nd, the denial of aU petitioned IbI1eIIdments to the
Comprehensive Plan Map for deasity ålanges.

Other proposed aœœdments arc held for further study to develop material changes
to them, with the exception to the amendment regilding the ftoodplaill map s. The
Plan now reads that the maps are Cmp. of Engineer oriented. The maps are, in fàct,
Federal Emergency Management Agency 1U8ps. The Planning md Zoning
Commi~n recommends approval of the FEMA map wendmMt to the P1m.
