1. CALL TO ORDER OF EMERGENCY SPECIAL MEETING: Authority
pursuant to Idaho Code 67-2343(2). Mayor Merrill calls the meeting to order.
2. ROLL CALL: BASTIAN, SEDLACEK, GUERBER, NORDSTROM. Council
Member Nordstrom is present by speakerphone and Council Member Sedlacek is absent.
A quorum is present.
3. NEW BUSINESS:
A. Resolution No. 04-17 Declaring An Emergency.
Mayor introduces the issue.
Bastian moves to approve Resolution No. 04-17 declaring an Emergency Special
Meeting. Seconded by Guerber. ALL AYES: MOTION CARRIES............
4. EXECUTIVE SESSION: Discussion on Litigation, Idaho Code 67-2345(f)
Mayor introduces the issue.
Bastian moves to go into Executive Session for the discussion of litigation in
accordance with Idaho Code 67-2345(f). Seconded by Guerber. Bastian: AYE;
Guerber: AYE; Nordstrom: AYE: ALL AYES: MOTION

Council discusses litigation.
Council leaves Executive Session at 6:55 p.m.
Nordstrom moves to turn down the Stipulation for Acceptance of Settlement as
presented tonight by Idaho Power Company because the Stipulation is not what was
negotiated between the parties and is not in the best interest of the citizens of the
City of Eagle. Seconded by Bastian. TWO A YES: ONE NAY: MOTION
CARRIES................. .
5. ADJOURNMENT:
Bastian moves to adjourn. Seconded by Guerber. ALL A YES: MOTION
CARRIES...
Hearing no further business, the Council meeting adjourned at 7:30 p.m.
