Eagle Rod CITY OF EAGLE I In the Matter of: ) ) ) FINDINGS OF FACTS AND CONCLUSIONS OF LAW SSe St. Mathews Catholic Church On September 18, 1989, pursuant to public notice and hearing procedures set forth in Section 67-6509 of the Idaho State Code, this matter came before the Eagle Planning and Zoning, City of Eagle, Idaho. The hearing was requested by Wayne Adams for a Conditional Use Permit in order to establish St. Mathews Catholic Church on the property located at 555 N. Eagle Rd. Father Dennis Day, Pastor of the church, represented Mr. Adams at the hearing. Based on testimony from the applicant and interested parties, together with all documentary evidence submitted concerning the applicant, the Eagle Planning and Zoning Commission finds the following; FINDINGS OF FACTS AND CONCLUSIONS OF LAW: 1. 2. The records in this matter indicate all notices, and publications have occurred as required by law. the records fuhrer reflect notice of the proposed conditional use permit was sent to the appropriate public and private entities with responses not objecting to the proposal being received from those entities; On September 18, 1989 public hearing proceedings were conducted with Eagle Planning and zoning Commission. Testimony was favorable. 3. The application by St. Mathews Catholic Church for a Conditional Use Permit complies with the Eagle City Code Title 8, Section 7-3-2, the General Standards for Conditional Use. 4,' In compliance with Title 8, Section 7-3-5 (d) Conditions of Permit, the Commission finds that it would be in the best interest of the project to monitor the sequence and timing of the development by recommending to Council that the progress be monitored by the Design Review Committee through each phase. 4. The granting of the Conditional Use Permit will not violate the Idaho Code nor nullify the interest or purpose of the Eagle City Code or Eagle Comprehensive plan with the conditions set forth by the Eagle Planning and Zoning Commission. 5. Based upon the foregoing Findings of Facts and Conclusions of Law the Eagle Planning and zoning Commission recommend to the Eagle City Council approval of the Conditional Use Permit for St. Mathews Catholic Church with review of the Design Review Committee at each phase.
