FINDINGS OF FACT AND
CONCLUSIONS OF LAW
On November 21, 1988, pursuant to public notice and hearing procedures
set forth in Section 67-6509 of the Idaho Code, this matter came before
the Eagle Planning and Zoning Commission in the City of Eagle, a public
hearing upon the request of Reverand Ray E. Venghaus, representative
for the HOPE LUTHERAN CHURCH for a rezone of the church property.
The application was for consideration of a rezone from R-5 to C-l in
order to build a church on properly zoned property.
Testimony regarding this matter was heard by Reverand Ray E. Venghaus,
and LaRue Bevington, in favor of the proposed rezone.
Testimony was also heard from Scott Gurnsey and John Sharp representing the
State of Idaho Transportation District. A letter was read into record
stating that the district was not opposed to the rezone request, but
asked for a one year moratorium on building in the area. The letter
stated that the moratorium was to allow time to evaluate options for
and firm up location of the upcoming Bypass.
Based upon testimony from the applicant and interested parties together
with all documentary evidence submitted concerning the application the
Eagle Planning and Zoning Commission recommends the following
FINDINGS OF FACTS:
1. The records in this matter indicate all notices, public hearings,
and publications have occurred as required by law. The records further
reflect notice of the proposed change appropriate to the public and
private entities with responses having been received from those entities;
2. The proposed rezone fulfills the purposes of zoning development as
set forth in Title 8, of the Eagle City Code;
3. Based on the facts submitted to it, the Commission finds that the
proposed development can be justified at the location proposed;
4. Based on the facts submitted to it, the Commission finds that the
land use is in general conformance with the Comprehensive Plan.
CONCLUSIONS OF LAW:
1. The Eagle Planning and Zoning Commission recommerds that Eagle
City Council approve the Rezone request for a Church building site,
on South Eagle Road, South of State Street, West side of Eagle Road.
The Commission further recommends that the property should be rezoned
C-l, Neighborhood Business District as requested.
