Findings - PZ - 1988 - vacation of pedestrian easement - Vacation Of Easement Lot Line Between Lots 5/6 Blk 1 CITY OF EAGLE PLANNING AND ZONING COMMISSION In the Matter of: ) ) ) ) FINDINGS OF FACT AND CONCLUSIONS OF LAW BANBURY SUBDIVISION Vacation of Pedestrian Easement On September 6, 1988, pursuant to public notice as required by law, this matter having come before the Eagle Planning and Zoning of the City of Eagle, Idaho, for public hearing upon the application of BanBury Subdivision, as Representated by Larry Sale, Area Manager for Centrac Eng. for vacation of pedestrian easement within BanBury. The easement is located ten feet on either side of the lot line between lots 5 and 6 of block 1. After hearing testimony from the applicant and interested parties and being advised in the matter the Eagle Planning and Zoning recommends the following: FINDINGS OF FACTS AND CONCLUSIONS OF LAW 1. Approval of the application for vacation of easement as it was caused by the construction of the pedestrian path outside of the easement. 2. The purchaser of the lot upon which the trail is located, Mr. and Mrs. Morgan Masner, and The Hoff Companies, are cooperating in this request by mutual consent. DATED this ~" .d.kdaY~~, 1998.
